Recommendations:
IUs respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report EGD-09-02 be received;
2. THAT the request from the Newtonville Hall Board for designation of a disabled
on-street parking spaced fronting the community hall be fulfilled;
3. THAT the by-law attached to report EGD-09-02 be approved; and
4. THAT a copy of this report be forwarded to the Newtonville Hall Board and to
Durham Regional Police.

1.0 BACKGROUND
1.1 Mr. Wallace Boughen of the Newtonville Hall Board verbally requested, through
his Council representative, that a disabled parking space be designated in front
of the Newtonville Community Hall on Church Street in Newtonville.
2.0 COMMENTS
2.1 Designation of Disabled Parking Spaces
A municipality may, with the passing of a by-law, designate disabled parking
spaces for either on-street or off-street locations. To be enforceable, a
designated disabled parking space must be posted with an official sign as shown
in the Ontario Traffic Manual (OTM), clearly indicating the parking stall. Disabled
parking permit signs may be augmented, but not replaced, by pavement
markings. The application of pavement markings, although not legally required, is
strongly recommended as it provides an addition visual aid and reduces the
number of motorists who may attempt to contest the substantial $300.00 fine.
Designated disable parking spaces are listed in schedules of the municipal Traffic
By-law 91-58.
2.2 Fine Structures on Municipal Property and Road Allowances
Every disabled parking space within a municipal road allowance must be
designated by a municipal by-law and is subject to a $300.00 set fine with an early
payment fine reduced to $200.00, if paid within 7 consecutive days. Disabled
parking spaces in Municipal off-street, parking lots and recreational complex
facilities are also covered by by-law and are subject to the same fine structure as
on-street parking infractions.
2.3 Fine Structures on Private Property
Disabled parking spaces may also be designated and listed in the schedules of
Traffic By-law 91-58 for private property and are subject to the same set fine of

$300.00 with an early payment fine reduced to $200.00. If a private property
owner posts a disabled parking permit sign but the space has not been
designated by a municipal by-law, only the lesser charge of "parked on private
property without owners consent" may be issued with a set fine of $23.00 and an
early payment fine of $15.00.
2.4 Newtonville Community Hall
In most cases, it is desirable to provide disabled parking in a 4.1 metre wide, off-
street parking stall, which improves safety by eliminating the possibility of a
disabled person stepping into high speed traffic. This property at #21 Church
Street, does not have any off-street parking facilities, requiring patrons to park on
Church Street and other adjacent streets if necessary. Traffic volumes and speed
are both low on Church Street and it would not appear to be hazardous for a
disabled motorist exiting their vehicle. The requested disabled parking space is
on the gravel shoulder directly in front of the Community Hall. The Operations
Department has agreed to pave the gravel shoulder area to improve access and
to apply pavement markings consisting of a blue boarder and a white disabled
parking symbol to augment the disabled parking permit sign which would need to
be installed. This work will be performed by the Operations Department as
weather permits.
2.5 Proposed By-law
A by-law has been attached to this report for Council's consideration to designate
the disabled parking space, showing both the existing name of Church Street and
the new name of Church Lane which will be effective June 1, 2002 as per By-law
2001-197 amending By-law 86-112, a by-law to establish a street name map and
street name inventory in the Municipality of Clarington.

Being a By-law to amend By-law 91-58, as amended, being a By-
law to Reguiate Traffic on Highways, Municipal and Private Property
in the Municipality of Clarington.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it desirable toamend
By-law 91-58;
