Subject: TENDER CL95-5, WATERFRONT TRAIL CONSTRUCTION
COBBLEDICK ROAD TO BALDWIN STREET
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
I
1 . THAT Report TR-19-95 be received;
2 . THAT Harnden and King Construction, Brooklin, Ontario, with a
total bid in the amount of $71, 741 . 45, being the lowest
responsible bidder meeting all terms, conditions and
specifications of Tender CL95-5, be awarded the contract for
the Waterfront Trail Construction, Cobbledick Road to Baldwin
Street, as required by the Department of Public Works;
3 . THAT the funds required in the amount of $90, 000 . 00
($71, 741 .45 bid and $18, 258 . 55 Consulting Contingencies) be
drawn from the Waterfront Trail Reserve Fund Account ##2900-
00030-0000; and
4 . THAT the attached By-law, marked Schedule "A" be forwarded to
Council for approval .
BACKGROUND AND COMMENT:
Tender specifications were provided by Totten Sims Hubicki
Associates for the Waterfront Trail Construction, Cobbledick Road
to Baldwin Street, as required by the Department of Public Works .
Tenders were advertised in the local papers, as well as the Daily
Commercial News . Subsequently, tenders were received and tabulated
as per Schedule "B" attached. j

The total project cost as detailed in the letter from Totten Sims
Hubicki Associates, marked Schedule "C" , is estimated at
$90, 000 . 00 . The total estimated cost for Phase I is $259, 162 . 00 .
The initial portion of the construction of the Waterfront Trail was
awarded in November of 1994, Tender CL94-40, Wilmot Creek
Pedestrian Bridge (partial Phase I) to Ron Robinson Limited in the
amount of $73 , 351 . 72 ($95, 000 . 00 total cost including consulting) .
Total costs expended to date on Phase I including the previous
Tender CL94-40 and miscellaneous operating is approximately

$135, 000 . 00 . Tender CL95-5 represents the balance of the trail
construction for Phase I . Phase I will receive 75% subsidy from
the Waterfront Regeneration Trust . To date, the Municipality has
received 500 of the total subsidy available . This amount plus any
remaining funds provided in the 1994 Capital Budget for the
Municipality' s portion, have been allocated to Account #2900-00030-
0000, Waterfront Trail Reserve Fund Account .
It is therefore proposed that the required funds in the amount of
$90, 000 . 00, be drawn from the Waterfront Trail Reserve Fund,
Account #2900-00030-0000 .
The low bidder has previously performed satisfactorily for the
Municipality of Clarington.
The Treasurer has reviewed the funding requirements and concurs
with the recommendations . Queries with respect to department
needs, specifications, etc . , should be referred to the Director of
Public Works .

After further review and analysis of the bids by Public Works,
Totten Sims Hubicki Associates and Purchasing, it was mutually
agreed that the low bidder, Harnden and King Construction,
Brooklin, Ontario, be recommended for the contract for the
Waterfront Trail Construction, Cobbledick Road to Baldwin Street .

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 95-
Being a By-law to authorize a contract between
the Corporation of the Municipality of
Clarington and Harnden and King Construction,
Brooklin, Ontario, with respect to the
Waterfront Trail Construction, Cobbledick Road
to Baldwin Street .
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS :
1 . THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Municipality of Clarington
with the Corporation Seal, a contract between Harnden and King
Construction and said Corporation.
2 . THAT this agreement attached hereto as Schedule "A" form part
of this By-law.
By-law read a first and second time this day of April, 1995 .
By-law read a third and finally passed this day of April,
1995 .

Tenders for the above contract were opened at the Municipal Offices on Friday, March 17, 1995. The
bids received inclusive of GST are as follows:

We have checked the low bidder's tender and we are satisfied that all requirements have been met, An
Agreement to Bond and a Deposit Cheque in the amount of$2,000.00 accompanied the bid.
Harnden and King Construction has completed a number of contracts administered by Totten Sims Hubicki
Associates. Contracts completed have ranged in value up to $1,000,000.00. Recent contracts include the
reconstruction of Cedar Beach Road for the Township of Brock in 1994 ($450,000.00) administered from
the Scarborough office of Totten Sims Hubicki Associates, The work was completed in a very satisfactory
manner.

We are familiar with the quality of workmanship provided by this firm and we have no hesitation in
reconunending acceptance of the low bid.
The cost of the project is now estimated as follows:
1. By Contract $67,048.08
2. Design and Tendering 7,000.00
3. Contract Administration 7,000.00
4. Contingencies 3,278.55
Sub-total $84,326.63-
GST (Items 1, 2 and 3) 5,673.37
Total $90,000.00
All deposit cheques (other than those of low and second low bids may now be released.
