THAT Report TR-25-95 be received; 2 . THAT confirmation of the contract award to Bishop Construction, Concord, Ontario, with a total bid in the amount of $56,444 . 34, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender CL95-4, for the Waterfront Trail Construction, Waverley Road to West Beach Road, as required by the Department of Public Works be approved; 3 . THAT the funds required in the amount of $56, 999 . 90 ($56, 444 . 34 bid plus $15, 555 . 56 Consulting Contingencies less $15, 000 . 00 Contract Amendments) be drawn from the Waterfront Trail Reserve Fund Account ##2900-00030-0000; and 4 . THAT the attached By-law, marked Schedule "A" be forwarded to Council for approval . BACKGROUND AND COMMENT: Tender specifications were provided , by Totten Sims Hubicki Associates for the Waterfront Trail Construction, Waverley Road to West Beach Road, as required by the Department of Public Works . Tenders were advertised in the local papers, as well as the Daily Commercial News . Subsequently, tenders were received and tabulated as per Schedule "B" attached. i rHis u rrrn co av nECVCiEO'Ar REPORT NO. : TR-25-95 PAGE 2 TENDER CL95-4 The total project cost as detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "C" , was estimated at $72, 000 . 00 . The total estimated cost for Phase II was $65, 566 . 00 . Due to changes in staff, the number of Departments p involved, the urgency of the project and the initial tender price being over budget, the appropriate By-law and Council approval for Tender CL95-4 was inadvertently not obtained. Subsequent to the initial tender opening, the total bid was amended with the deletion of a culvert in the approximate amount of $15, 000 . 00 . The total cost value was therefore approximately $41, 444 . 34 plus $15, 555 . 66 Consulting Contingencies for a total of $56, 999 . 90 . Tender CL95-4 represents the trail construction for Phase II and will receive 100- subsidy from the Waterfront Regeneration Trust . To date, the Municipality has received 50- of the total subsidy available . This amount plus any remaining funds provided in the 1994 Capital Budget for the Municipality' s portion, have been allocated to Account #2900-00030-0000, Waterfront Trail Reserve Fund Account . It is therefore proposed that the required funds in the amount of $56, 990 . 90 be drawn from the Waterfront Trail Reserve Fund, Account #2900-00030-0000 . Although the low bidder had not previously performed for the Municipality of Clarington, they have provided satisfactory service for both the Town of East Gwillembury and the City of Barrie and have subsequently completed this contract satisfactorily. The Treasurer has reviewed the funding requirements and concurs with the recommendations . Queries with respect to department needs, specifications, etc . , should be referred to the Director of Public Works . i i i REPORT NO. : TR-25-95 PAGE 3 TENDER CL95-4 After further review and analysis of the bids by Public Works, Totten Sims Hubicki Associates and Purchasing, it is respectfully requested that Council endorse the award to the low bidder, Bishop Construction, Concord, Ontario, for the Waterfront Trail Construction, Waverley Road to West Beach Road. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS : 1 . THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal, a contract between Bishop Construction, o/a Bisquip Leasing Corporation and said Corporation. An Agreement to Bond and a Deposit Cheque accompanied the bid. We do not have any previous experience in working with Bishop Construction. We have, however, checked out several references provided by the Company and the comments received have been very favourable. This Contractor is highly recommended by staff from the Town of East Gwillimbury and by the City of Barrie.
