Subject: CHANGE TO PURCHASING BY-LAW #94-129

It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 • THAT Report TR-13-96 be received; and
2 . THAT Purchasing By-law #94-129, Paragraph 5, Item 5 . 15
Conflict of Interest be amended as identified in the body of
this report .

BACKGROUND AND COMMENT:
Purchasing By-law �
#94-129, Paragraph 51 Item 5 . 15, Conflict of
Interest, currently reads as follows :
"No employee of the Corporation or member of Council shall bid
on the sale of goods except those disposed of by Public
Auction. "
This section of the By-law does not address employees or members of
Council bidding on the supply of municipal goods or services .
To allow employees or members of Council to bid on the supply of
goods or services to the Municipality may give the perception that
they have an unfair advantage as they may have access to
information that others do not .

BY-LAW NUMBER 96-
being a By-law to amend By-law 94-129, a By-
law to define the purchasing and tendering
policies and procedures applying to the
purchase of all types of goods, works and
services by the Corporation of the
Municipality of Clarington, and to repeal By-
law #82-96 and #83-16 .
WHEREAS the Council of the Corporation of the Municipality of
Clarington has adopted the recommendations contained within Report
#TR-13-96 to address employees or members of Council bidding on the
supply of municipal goods or services .
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
CLARINGTON ENACTS AS FOLLOWS :
1 . THAT By-law 94-129, is amended by adding the following to
Paragraph 5, Item 5 . 15 :
"No employee or member of Council of the Municipality shall
sell goods or services to the Municipality or have a direct or
indirect interest in a Company or own a Company which sells
goods or services to the Municipality. ,,
2 . THAT this by-law shall be effective immediately.
By-law read a first and second time this day of March, 1996 .
By-law read a third time and finally passed this day of March,
1996 .
