THAT Report TR-69-97 be received; 2 . THAT Miwel Construction Limited, Stouffville, Ontario, with a total bid in the amount of $247, 860 . 15, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender CL97-12, be awarded the contract for the Sidewalk Construction, - Courtice Road, Regional Road No. 34, Stagemaster Crescent to Nash Road, - Highway No. 2, Trulls Road to Courtice Road, as required by the Department of Public Works; 3 . THAT funds in the amount of $100, 000 . 00 be drawn from Public Works Capital Account #7212-97001-0261; 4 . THAT funds in the amount of $150, 000 . 00 be drawn from Public Works Capital Account #7212-97002-0261; 5 . THAT additional funds in the amount of $34 , 831 . 10 be drawn from the Public Works Development Charge Reserve Account #1110-00184-0000 ; 6 . THAT the remaining required funds in the amount of $5, 907 . 03 be drawn from the Public Works Lot Levy Reserve Account #1110- 00157-0000; and 7 . THAT the attached By-law marked Schedule "All authorizing the Mayor and Clerk to execute the agreement be approved. X 19 REPORT NO. : TR-69-97 PAGE 2 TENDER CL97-12 BACKGROUND AND COMMENT: Tender specifications were provided by Totten Sims Hubicki Associates for the Sidewalk Construction, - Courtice Road, Regional Road No. 34, Stagemaster Crescent to Nash Road, - Highway No. 2, Trulls Road to Courtice Road, as required by the Department of Public Works . Tenders were advertised in the local papers, as well as the Daily Commercial News . Subsequently, tenders were received and tabulated as per Schedule "B" attached. The total project cost, including Project Administration, as detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "C" is estimated at $290, 738 . 13 , which includes design services, construction administration, materials testing, Ontario Hydro, Consumers Gas, Survey, Contingencies and G. S .T. rebate . The required funds will be drawn from Public Works Account #7205- 97001-0261 ($100, 000 . 00) , and 7212-97002-0261 ($150, 000 . 00) as identified on Pages 155 and 156 of the 1997 Capital Budget . Additional funds required in the amount of $5, 907 . 03 are recommended to be drawn from the Public Works Lot Levy Reserve Fund, Account #1110-00157-0000; the remaining required funds in the amount of $34, 831 . 10 being drawn from the Public Works Development Charge Reserve Fund Account #1110-00184-0000 . The subject firm has previously provided satisfactory service for the Municipality of Clarington. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc . , should be referred to the Director of Public Works . THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington, and seal with the Corporation Seal, a Contract between Miwel Construction Limited and said Corporation; and 2. THAT this agreement attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of July, 1997. Miwel Construction has completed a number of contracts in recent years on which Totten Sims Hubicki provided inspection. We are very familiar with the workmanship and contract administration standards of this company. Included in the contracts complete are Kingsdale North Subdivision, Town of Cobourg, $110,000 (1995), Francis Street reconstruction, Village of Fenelon Falls, $290,000 (1996), King Street urbanization, Municipality of Clarington, $260,000 (1995), and Liberty Street sidewalks, Municipality of Clarington, $135,000 (1994). Additional contracts recently completed or underway include road reconstruction in Trenton at $100,000 and Mill Street, Frankford at $150,000. To our knowledge there have been no liens placed on any of the contracts mentioned. We, therefore, recommend acceptance of the low bid. Based on Miwel's bid, we estimate the overall cost of the project as follows: 1. By Contract $231,645.00 2. Design Services (Dec. 22, 1996 to June 7, 1997) 13,551.40 3.
