Subject: CL97-20, FOSTER CREEK CULVERT EXTENSION, ROBERT STREET,
NEWCASTLE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report TR-95-97 be received;
2 . THAT B . N. Fenton Construction Ltd. Courtice, Ontario with a
total bid in the amount of $49, 755 . 00 including G.S .T. , being
the lowest responsible bidder meeting all terms, conditions
and specifications of Tender CL97-20, be awarded the contract
for Foster Creek Culvert Extension, Robert Street, Newcastle,
Ontario;
3 . THAT funds in the amount of $50, 000 . 00 (total project cost
$68, 374 . 60 including construction, final design, contract
administration, soils report, legal survey, contingencies and
G.S .T. ) be drawn from the approved 1997 Public Works Capital
Account 7205-97002-0261;
4 . THAT the additional funds required in the amount of $18, 374 . 60
be drawn from Public Works Lot Levy Reserve Fund #5001-00036-
0401; and
5 . THAT the attached By-law marked Schedule "All authorizing the
Mayor and Clerk to execute the agreement be approved;

BACKGROUND AND COMMENT:
Plans were provided by Totten Sims Hubicki Associates for the
Culvert Improvement, Newcastle, Ontario, as required by the
Department of Public Works . Tenders were advertised locally and in
the Daily Commercial News .

Subsequently tenders were received and tabulated as per Schedule
"B" attached
The total project cost including final design and tendering,
construction layout, contract administration, soils report, legal
survey, contingencies and GST, detailed in the letter from Totten
Sims Hubicki Associates, marked Schedule "C " is estimated at
$68, 374 . 60 .
Due to excessive ground water conditions and the requirement for
additional geo-technical design information, the cost of the
project has exceeded the budget amount of $50, 000 . 00 .
Consequently, it is recommended that funds in the amount of
$50, 000 . 00 be drawn from Public Works 1997 Capital Budget Account
7205-97002-0261 as reflected on Page 137 of the Capital Budget .
Additional funds in the amount of $18, 374 . 60 are recommended to be
drawn from the Public Works Lot Levy Reserve Fund Account #5001-
00036-0401 .
The Treasurer has reviewed the funding requirements and concurs
with the recommendation. Queries with respect to department needs,
specifications, etc . , should be referred to the Director of Public
Works .
The low bidder, B. N. Fenton Construction Ltd. , Courtice, Ontario
have completed work for the Region of Durham and the City of
Oshawa. References confirm that B. N. Fenton Construction Ltd. is
a capable contractor, work has been completed on time and in an
acceptable manner.
As the summer construction season is almost over, time is of the
essence, and in order to complete the culvert extension a FORTHWITH
approval is requested.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 97-
I
Being a By-law to authorize a contract between the Corporation
of the Municipality of Clarington and B.N. Fenton Construction
Ltd., Courtice, Ontario for the Foster Creek Culvert Extension,
Robert Street, Newcastle.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY
ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the
Corporation of the Municipality of Clarington, and seal with the Corporation Seal,
a Contract between B.N. Fenton Construction Ltd. and said Corporation; and
2. THAT this agreement attached hereto as Schedule "A" form part of this By-law.
By-law read a first and second time this day of October, 1997.
By-law read a third time and finally passed this day of October, 1997.

Tenders for the above project were opened at the municipal offices on Friday, September 19, 1997. The
bids received, inclusive of GST, are summarized as follows:

The low bidder's tender has been reviewed and is in order.
We have contacted references supplied by Penton Construction for contract work completed in 1996 and
1997 for the Region of Durham and the City of Oshawa and references confirm that Fenton is a capable
Contractor.
Works have been completed on time in an acceptable manner and to our knowledge no liens have been
placed on any contracts. The value of contracts completed ranges from $200,000 - $700,000. We have
also had experience in working with Penton Construction as a sub-contractor,
Currently, we are providing site inspection on a contract on Croft Street for the Town of Port Hope, being j
undertaken by Fenton Construction as the General Contractor at a cost of$250,000.
We recommend acceptance of the low bid for this contract.
