RICKARD RECREATION COMPLEX - TWIN PAD Recommendations: It is respectfully recommended to Council the following: 1 . THAT Report TR-101-97 be received; 2 . THAT Peak Engineering & Construction Ltd. , Brighton, Ontario, with a total bid in the amount of $4, 025, 925 . 00, (as negotiated) being the lowest responsible bidder meeting all terms, conditions and specifications of Tender CL97-27, be awarded the contract for the Construction of the expansion at the Garnet B . Rickard Recreation Complex; 3 . THAT funds required in the amount of $4, 075, 000 . 00 be drawn from the 1997 approved Garnet B. Rickard Recreation Complex Construction/Renovation Capital Budget Account #7606-00003- 0501, and as revised in accordance with the attached Schedule "An 4 . THAT the additional funds required in an approximate amount of $361, 000 . 00 (tender bid price of $4, 556, 000 . 00 negotiated to $4, 025, 925 . 00, plus $200, 000 . 00 contingencies, plus $218, 000 . 00 design and contract administration less $4 , 075, 000 . 00 budget allocation) be drawn from the Impact/Escrow Reserve Fund Account #5001-00050-0000; i 5 . THAT the attached By-Law, marked Schedule "B" authorizing the Mayor and Clerk to execute the necessary agreement be approved. i BACKGROUND AND COMMENT: Tender specifications were prepared by Barry Bryan Associates Limited for the construction of the twin pad at Garnet B. Rickard Recreation Complex, as required by the Department of Community Services . i 1 REC 8145 IS PR IMED M REGY-D PACER REPORT NO. : TR-101-97 PAGE 2 The list of pre-qualified bidders was advertised in the local papers, as well as the Daily Commercial News . Subsequently, tenders were received and tabulated as per Schedule "C" attached. In order to reduce the total bid price, the Architect and staff met with the low bidder to review the submission and negotiate cost reduction measures . The items that were identified do not pose an operational problem or affect the overall appearance of the building. For the information of Council, one of the negotiated items includes extending the substantial completion of the twin pad by approximately six (6) weeks, which would be September 15, 1997 . This change resulted in a $35, 000 . 00 savings . The total funds required for the contract are as follows : Tender Bid Price $4 , 556, 000 . 00 Contingencies $ 200, 000 . 00 Design/Contract Admin. $ 210, 000 . 00 TOTAL $4, 966; 000 . 00 Less Negotiated Reductions $ 530, 075 . 00 TOTAL REVISED BUDGET:: 5y92500 Less Approved Budget $4 , 075, 000 . 00 REQUIRED FUNDS $ 360; 925 . 00 It is recommended that $4 , 075, 000 . 00 be drawn from the approved revised 1997 Capital Budget allocation, and that the additional funds required in an approximate amount of $361, 000 . 00 be drawn from the Impact/Escrow Reserve Fund Account #5001-00050-0000 . The Treasurer has reviewed the funding requirements and concurs with the recommendation. REPORT NO. : TR-101-97 PAGE 3 Queries with respect to the building needs, specifications, etc . , should be referred to the Director of Community Services . After further review and analysis of the bids by Community Services, the Property Manager, the Purchasing Manager and the Barry Bryan Associates (see Schedule "D" attached) , it was mutually agreed that the low qualified bidder, Peak Engineering & Construction Limited, be recommended for the contract for the construction of the expansion to the Garnet B. Caruana, DiiZctor of Community Services MM*LB*ld SCHEDULE "A" Council Minutes - 23 - September 29, 1997 REPORTS a) Releasing each other from any further obligations under the September 29th, 1978 agreement. b) For the indemnification of the Municipality should it be established that the representations of the,parties are inaccurate that (i) the money had been paid to the Municipality, (ii) the money had not been previously paid back to the parties or (iii) the parties are the proper recipients of the return of the money. THAT a by-law be passed to authorize the Mayor and Clerk to enter into this agreement on behalf of the Municipality. "CARRIED" Report #5 Resolution #C-679-97 Rickard Moved by Councillor Hannah, seconded by Councillor Novak Recreation Complex Site Works THAT Report CS-10-97 be received; and R05.RI THAT the additional funds required to complete the site works necessary for the twin pad of the Rickard Recreation Complex, approximately: 575,000 he approved and financed from the Impact/Escrow Reserve Fund Account #5001-500-X. "CARRIED" Councillor Novak made a declaration of interest with respect to Report #7; vacated her chair and refrained from discussion and voting on the subject matter. Councillor Novak indicated that one of the companies mentioned in the report has business dealings with her company. "CARRIED" Resolution #C-681-97 Moved by Councillor Dreslinski, seconded by Councillor Novak THAT the Chief Administrative Officer review the Municipality's pre-qualification policy and report back to the General Purpose and Administration Committee. "CARRIED" i i SCHEDULE "B" THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 97- Being a By-law to authorize a contract between the Corporation of the Municipality of Clarington and Peak Engineering & Construction Ltd., Brighton, Ontario, for the construction of the twin pad expansion at the Garnet B. Rickard Recreation Complex. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington, and seal with the Corporation Seal, a Contract between Peak Engineering & Construction Ltd. and said Corporation; and 2. THAT this agreement attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of October, 1997. By-law read a third time and finally passed this day of October, 1997.
