SUBJECT: APPLICATION FOR REZONING Z-A-1-6-10
PART OF LOT 34, CONCESSION 2, FORMER
TOWNSHIP OF DARLINGTON
RECOMMENDATION:

It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-98-82 be received; and
2. That application for rezoning Z-A-1-6-10 be
approved and that the attached By-law 82-
be forwarded to Council for approval at such
time as By-law 81-123 has received Ontario
Municipal Board approval .
BACKGROUND: j
The subject application for rezoning requests a zone change
on a 1030.0 square metre (11 ,087 square feet) triangular
parcel of land forming part of an existing
commercial/residential lot. This lot has frontage on the
south side of Highway Number 2, east of Darlington Boulevard
South. The requested By-law amendment would rezone this
parcel of land "Special Purpose Commercial ".

The subject lands are designated "Residential " by the Region
of Durham Official Plan and Special Purpose Commercial by
the Courtice Urban Area Plan. The inclusion of this
triangular parcel of land within the proposed Special
Purpose Commercial zoning is in conformity with all
applicable Official Plan policies.
The subject parcel of land is presently zoned
"R2-Residential " by Restricted Area (Zoning) By-law 2111 , as
amended, of the former Township of Darlington. The proposed
amendment would change the zoning of this site to "Special
Provision By-law 81-123" in conjunction with the Special
Purpose Commercial zoning which exists on the northerly
portion of this lot.
In accordance with departmental procedures, the application
was circulated to various departments and agencies for
comment. The following is a list of the comments received:
The Region of Durham Planning Department
"The subject site is designated "Residential " in the Durham
Regional Official Plan and "Special Purpose Commercial" in
the Courtice Urban Area Plan (Amendment No. 12 to the
Official Plan of the former Darlington Planning Area). The
proposal to amend By-law 81-123 by incorporating the subject
site within the Special Purpose Commercial node conforms."

The Region of Durham Public Works Department
"With respect to Regional services; sanitary sewer and water
supply facilities are not available to the subject site and
the Region has no plans to provide these services to this
portion of the Courtice Urban Area. However, we understand
that By-law 81-123 will be amended to include a requirement
for full municipal services prior to development and
accordingly the proposal will conform to servicing
provisions of the Durham Plan."

The Newcastle Public Works and The Central Lake Ontario
Conservation Authority had "no objection to the approval of
the application.
COMMENTS:
Staff have reviewed the application submitted by Mr. Moase
and note that the application requests a minor change in
zoning in order to redefine the limits of the Commercial
zone as it pertains to the subject lands. The majority of
Mr. Moase's commercial operation has been rezoned by Special
Provision By-law 81-123.
Staff note that due to objections received, Special
Provision By-law 81-123 requires the approval of the Ontario
Municipal Board. Staff are, however, recommending that
By-law 81-123 be amended to include this triangular parcel
of land within the Special Purpose Commercial zone, and that
the attached By-law be considered by Council at such time as
the Ontario Municipal Board has dealt with By-law 81-123.
