SUBJECT: APPEAL TO THE ONTARIO MUNICIPAL BOARD
OF MINOR VARIANCE APPLICATION A-8/82
BY SIB-JEL INVESTMENTS LIMITED
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-87-82 be received; and
2. That the Council of the Town of Newcastle
hereby acknowledges the Appeal to the Ontario
Municipal Board on Committee of Adjustment
application number A-8/82 by Sib-Jel
Investments and hereby authorizes Town staff
and/or the Town Solicitor to represent the Town I
at any such hearing that may be convened.

BACKGROUND:

An application had been filed by Sib-Jel Investments Limited
for exemption from the provisions of By-law 1587, as
amended, of the former Town of Bowmanville. The relief
sought would permit the applicant to construct a
three-storey addition to the existing plaza located on the
corner of Simpson and King Streets in Bowmanville. The
proposed addition would contain commercial and residential
uses. a

The variance sought related to side yard requirements. The
By-law requires six (6) metres, or approximately twenty (20)
feet, and the applicant was seeking permission to build
within 1 .8 metres, or six (6) feet of the property boundary.
Planning staff reviewed this application and recommended
that the application for minor variance be denied, as the
existing development does not presently meet the By-law
requirements relative to parking. In addition, Dominion
Stores possess a valid easement over the lands affected by

the proposed expansion, restricting the erection of any new
building on the site.
The subject application was considered by the Committee of
Adjustment on March 24th, 1982. The Committee's Decision
was as follows:
"That the existing development does not presently meet the
By-law requirements relative to parking, and the fact that
the Dominion Store possesses what appears to be a valid
easement over the lands affected by the proposed expansion,
the application to construct a three-storey addition to the
existing building, leaving a side yard of 1 .829 metres (6
feet) to the east and maintaining a zero (0) sideyard to the
t west, is denied."
Staff also note that on April 5, 1982, staff Report PD-59-82
in respect of Sib-Jet 's application for site plan approval
was considered by the General Purpose and Administration
Committee and denied.

Planning staff are in support of the Committee of
Adjustment' s Decision and are now requesting permission to
appear at the Ontario Municipal Board Hearing in support of
that position.
