(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MAY 17, 1982 REPORT NO.: PD-85-82 SUBJECT: APPLICATION FOR REZONING Z-A-1-2-8 PART OF LOT 22, BROKEN FRONT CONCESSION, FORMER TOWNSHIP OF DARLINGTON - OSHAWA GENERAL RACING PIGEON CLUB RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-85-82 be received; and 2. That application for rezoning, Z-A-1-2-8 be approved; and * 3. That the attached By-law 82- be forwarded to Council for approval at such time as the applicants submit lot grading and drainage plans and receive approval of same from the Director of Public Works. BACKGROUND: The subject application for rezoning requests an amendment to Restricted Area (Zoning) By-law 2111 , of the former Township of Darlington to rezone a .49 hectare (1 .217 acres) parcel of land located in Part of Lot 22, Broken Front Concession, Darlington. �f 11� Report No: PD-85-82 .. ./2 The requested By-law amendment would allow the applicants to construct clubhouse facilities for members of a racing pigeon club. The subject lands are designated "Major Open Space" in the Region of Durham Official Plan. Recreational uses are permitted under this landuse designation, provided that such recreational uses are compatible with abutting uses and properties in the area. In that regard, the proposed facilities appear to conform with the policies of the Regional Plan. The site is presently zoned "A-Agricultural " by Restricted Area (Zoning) By-law 2111 , as amended, of the former Township of Darlington. The proposed By-law amendment would apply a "Special Provision By-law" for this site in order to allow the proposed use. In accordance with Departmental procedures, the subject application was circulated to various Departments and Agencies for comments. The following is a list of the comments received: The Region of Durham Planning Department: "We note that the subject site is designated "Major Open Space" in the Durham Regional Official Plan. Section 12.2.2 of the Durham Plan stipulates that recreational uses may be allowed in this designation provided that such recreational uses are compatible with their surroundings and are in conformity with the intent of the Plan." The Region of Durham Health Unit: no objection" Report No: PD-85-82 .. ./3 The Ministry of Agriculture and Food: "I did check out the 1 .217 acre site which the Oshawa General Racing Pigeon Club wishes to develop as a racing pigeon site. I note that it is bounded on the north and west by roads and on the south-east, the railroad passes, making the piece of property a triangle. It does not seem to be near to any housing or anything else, and I cannot see any great problem in their taking it over for the use they have in mind. It would appear that it has been worked on occasion, but with present day equipment, there is not much of a loss to agriculture - if any." The Canadian Pacific Railway: "no objections" The Newcastle Fire Department: "There is no water supply for fire protection within this area. Building should be limited to one-storey, designed in accordance to occupancy A2, Ontario Building Code. Response time for fire emergency service would be _ approximately 12 minutes. Consideration should be given to installing a water supply reservoir approximately 22,500 litres." The Newcastle Building Department: "no comment" The Newcastle Long Range Planner: no objection The Newcastle Public Works Department: "1 . That the application be approved and that the Owners enter into a Site Plan Agreement with the Town of Newcastle." 2. That the Owners prepare a Site Plan indicating the location of the proposed building, access, parking facilities, drainage, floodlighting all to the satisfaction of the Director of Public Works." Report No. : PD-85-82 . . ./4 COMMENTS: Staff have reviewed the comments received regarding the rezoning of the subject lands and we note that there were no significant problems in respect of establishing a racing pigeon club in this area. The proposal appears to conform with the policies of the Durham Regional Official Plan. Planning staff, therefore, have no objection to the approval of this rezoning application. With respect to the Site Plan related comment submitted by the Newcastle Public Works Department, Planning staff believe that the proposed use is "technically" a recreational type use and as such a Site Plan would "technically" be required. However, the use could also be considered "quasi-agricultural ". We are, therefore, suggesting that a Site Plan not be required, but that as a condition of rezoning, the applicants be required to submit lot grading and drainage plans to the Director of Public Works in order to ensure that there will be no adverse effects in terms of runoff from this site. Frank Real Estate 115 Simcoe Street South OSHAWA, Ontario THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 82- being a By-law to amend By-law No. 2111 , as amended, of the former Township of Darlington, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law 2111 , as amended, of the former Township of Darlington. NOW, THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1 . Map 26 of Schedule "A" to By-law 2111 , as amended, is hereby further amended by changing to "SPECIAL PROVISION BY-LAW 82- the zone designation of lands indicated as "ZONE CHANGE TO SPECIAL PROVISION BY-LAW 82- " on the attached Schedule "X" hereto. 2. Section 13 of By-law 2111 , as amended, is hereby further amended by adding thereto subsection (aa) as follows: "(aa) Part of Lot 22, Broken Front Concession Notwithstanding any provisions of this By-law to the contrary, that portion of Lot 22, designated "SPECIAL PROVISION BY-LAW 82- " on the attached Schedule "A" hereto shall be used only in accordance with the following provisions: (1 ) Permitted Uses a) a pigeon racing clubhouse facility, and buildings and structures accessory thereto. (2) Zone Provisions a) Lot Area (minimum) .45 hectares b) Lot Frontage (minimum) 50.0 metres c) Front Yard (minimum) 12.0 metres d) Interior Side Yard (minimum) 27.0 metres e) Exterior Side Yard (minimum) 12.0 metres f) Rear Yard (minimum) 130.0 metres g) Building Height (maximum) 10 metres 3. This By-law shall come into effect on the final passage hereof.
