FOR THE APPROVAL OF BY-LAW -79, BEING AN AMENDMENT TO BY-LAW 3415 OF THE CORPORATION OF THE CITY OF OSHAWA AND AN AMENDMENT TO THE OFFICIAL PLAN FOR THE FORMER CITY OF OSHAWA PLANNING AREA RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-82-82 be received for information. BACKGROUND AND COMMENT: On April 29, 1982, the attached Notice of an Ontario Municipal Board Hearing was received by the Planning and Development Department. Said Notice arose from appeal by G.R.W. Construction Limited for the approval of an amendment to By-law 3415 of the City of Oshawa, and, an amendment to the Official Plan of the former City of Oshawa Planning Area. fryP� ti Report: PD-82-82 . . ./2 The requested change in these documents would permit the construction of a shopping centre to be located on the northwest corner of Taunton Road and Ritson Road North within the limits of the City of Oshawa. The subject parcel of land is located in an area of the City of Oshawa which would not have an adverse effect on the Town of Newcastle. In that regard, representation by the Town of Newcastle at the Ontario Municipal Board Hearing would not be required. However, we note that the Hearing is scheduled for Monday, June 28, 1982. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of the Corporation of the City of Oshawa by the Council thereof as follows:- 1. That By-Law Number 3415 as amended is hereby further amended by amending Schedule "A" thereof by adding Special Condition No. as follows :- SPECIAL CONDITION The lands shown on Schedule "A" hatched and marked C-1 with the figure " encircled shall be subject to the special regulations herein after contained and where there is any conflict between the regulations hereinafter set out and any other provisions of this by-law or by-law number 55-73, these special regulations shall apply, but in the event that this Special Condition is silent on any matter, the provisions applicable to a C-1 use district shall apply. 1.1 Defined Area: The area subject to this Special Condition. is as shown. on Schedule "A" hereto, outlined in a heavy line and hatched with the f iqure encircled. 1. 2 Development Control : As a condition of development or re-development of any land to which this Special Condition applies, the provision of Section 47B of this by-law as amended shall apply to the land affected. 2. Sheet Number 3 of Appendix "A" to By-Law Number 3415 as amended is hereby further amended by changing the land use designation of a parcel of land on the North-West corner of Taunton Road East and Ritson Road North having a frontage of 663..9 feet on Taunton Road East and a 'frontage of 437. 0 feet on Ritson Road North in part from R.-1B to C-1 and in part from R---2-,A to C- l shown, hatched and marked with the figures encircled and making the lands designated C-,1, subject 2 - to Special Condition so that the said Sheet Number 3 as amended by this by-law shall be amended as shown on the revised Sheet Number 3 attached to this by-law as Schedule 3. Shcedule "A" attached hereto shall form part of this By-Law. 4 . No part of this by-law shall come into force without the approval of The Ontario Municipal Board but subject thereto this by-law shall take effect from the date of its passing. O.M.B. No. R80453; AMENDMENT NO. TO THE OFFICIAL PLAN FOR THE FORMER CITY OF OSHAWA PLANNING AREA. THE OFFICIAL PLAN FOR THE FORMER CITY OF OSHAWA PLANNING AREA IS HEREBY AMENDED AS FOLLOWS: 1. LAND USE MAP: The Land use category of the lands described in Schedule "A" hereto as shown on the Land Use Map which forms part of The Official Plan for the former City of Oshawa Planning Area, being Schedule "A" to said Official Plan, as amended shall be re-designated from "Residential" to "Planned Commercial Centre" . SCHEMA; "n" Description All and singular that certain parcel or tract of land and premises situate, lying and being in the City of Oshawa, in the Regional' Municipality of Durham and being composed of Part of Lot 2, Sheet 9E according to East Whitby Muni- cipal Plan 370, designated as Parts 1, 2 and 3 on Plan of Survey of Record filed in the Land Registry Office for the Land Titles Division of Durham at Whitby as No. 40R-.3283. Approximately 6.3 acres. Lot size as follow s: Frontage approximately 604 feet x depth of approximately 420 feet vacant land. Explanatory Note. Both such applications refer to the same desired amendment.
