(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MAY 3, 1982 REPORT NO. : PD-73-82 SUBJECT: REQUEST FOR SUBMISSION OF A MINOR VARIANCE APPLICATION ON BEHALF OF THE TOWN OF NEWCASTLE FOR LOTS 14, 15, 16 and 17, REGISTERED PLAN 707, FORMER TOWN OF BOWMANVILLE RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-73-82 be received; and 2. That the Planning Department be authorized to take the necessary steps to notify the affected property owners and to undertake, on behalf of the Town and these owners, an application to the Committee of Adjustment for appropriate minor variances for Lots 14 to 17 inclusive, Registered Plan 707. BACKGROUND AND COMMENT: On April 1 , 1982, staff received a request for zoning clearance with regards to the sale and subsequent purchase of 75 Roser Crescent, being part of Lot 15, Registered Plan 4 Report No. : PD-73-82 .. . ./2 707 of the former Town of Bowmanville (copy of which is * attached). In reviewing this clearance request, staff noted that the subject property was zoned "R2-Residential ", and, did not conform with the lot area requirements of this zoning classification. A further review of Registered Plan 707 indicated that there were a total of four (4) semi-detached lots, the subject lot included, which do not conform with the "R2" zone provisions. We note that each lot is approximately 16.7 sq. m. (180 sq. ft. ) short of the lot area required. By-law 72-32, a By-law which changed the zoning of this area in order to allow the development to proceed, failed to recognize this non-conforming situation in respect of lot area. At that point in time, while the subdivision was still under review, this discrepancy would have more appropriately been remedied. However, Plan 707 was registered, in 1973, under the jurisdiction of the former Town of Bowmanville and building permits for these lots issued. Staff are, therefore, requesting permission to submit an application for minor variance to the Committee of Adjustment on behalf of the Town, in order to rectify this problem and to avoid future problems with these particular semi-detached lots.
