(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MAY 3, 1982 REPORT NO. : PD-71-82 SUBJECT: BY-LAW NUMBER 18-82: THE CORPORATION OF THE TOWNSHIP OF SCUGOG RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council -the following: 1 . That Report PD-71-82 be received; and 2. That By-law Number 18-82 of the Township of Scugog be received and filed. i BACKGROUND AND COMMENT: By-law 18-82 of the Township of Scugog was forwarded to the Planning and Development Department on April 20, 1982. The subject By-law amendment revises the boundary of the Environmental Protection (EP) Zone in part of Lot 14, Concession 9, within the Township of Scugog. This revision includes the rezoning of certain portions of the lands in this lot and concession to Environmental Protection and Rural zones adjacent to the shoreline of Lake Scugog. i ,i J Report No. : PD-71-82 . . ./2 ` The subject By-law amendment covers an area within the Township of Scugog which would not affect the interests of the Town of Newcastle, therefore no further action on this By-law will be required. TAKE NOTICE that the Council of the Corporation of the Township of Scugog intends to apply to The Ontario Municipal Board pursuant-to the provisions of Section 3 9.of The Planning Act for approval of By-Law No. 18-82 passed ' on the 12th day of April , 1982. ANY PERSON INTERESTED MAY, within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the clerk of the Town- ship of Scugog notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which you object and detailed reasons therefor,.and shall indicate that if a hear- ing is held the objector or an agent will attend'at the hearing to aupport the objection. . ANY PERSON wishing to support the application for approval of the by-law i may within twenty-one (21) days after the.date of this notice send by registered mail or deliver to the clerk of the Township of Scugog notice of his support of approval of the said by-law together with a request for notice of any. hearing that may be held giving also the name and address to which such notice should be given. 71iE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the bye law will be considered. APR J90� ' i EXPLANATORY NOTE i PURPOSE OF BV-LAWS The purpose of the attached By-law is to further amend Restricted Area By-law 75-80, as amended by By-law No. 72-81, of the Corporation of the Township of Scugog. This amendment to By-law No. 75=80,as amended serves to revise the boundary of the Environmental Protection (EP) Zone in part of Lot 14, Concession 9, Ward Four, in accordance with a recent report received from the Ministry of Natural Resources. j LOCATION OF LANDS AFFECTED: , The lands affected by th. By-law amendment are located north of Regional Road No. 57 adjacent the shoreline of Lake Scugog at Williams Point, in part of Lot 14, Concession 9, Ward Four, of the Township of Scugog. Reference should be made to the Zone Map forming part of this amendment for the accurate delineation an.4 i location of the subject lands affected by this amendment. +`FF CT OF THE BY-LAW: , The effect of the attached By-law is twofold; (i) first, it serves to rezone a portion of the lands in ques% ;c. from the Environmental Protection (EP) Zone to. the Rural (!z11 Zone, and, (ii) secondly, it serves to rezone a portion of the lands in question from the Rural (RU) Zone to the Environmental Protection (EP) Zone. i c I j I I I I ! BEING A BY-LAW PASSED 'URSUANT TO THE PRO- VISIONS OF SECTIQN 39 uF THE PLANNING ACT, i1 R.S.O. , 1980, c. 379, AS AMENDED, TO AMEND RESTRICTED-AREA BY-LAW NO. 75-80, AS FURTHER AMENDED BY BY-LAW NO. 72-81. I� iI t WHEREAS the Council of the Corporation of the Township ! of Scugog enacted Restricted Area By-Law No. 75-80, being the. Comprehensive Zoning By-Law, on January 26, 1981, to regulate -the use of lands, and the character, location and use of building ;f f I and structures within the whole of the Municipality; (I i AND WHEREAS the Council of the Corporation of the Town- e I ship of Scugog enacted By-Law No. 72-81, which, in addition to ii various other matters, served to revise the boundaries of the �! Environmental Protection (EP) Zone in part of Lot, 14, Concession 9, Ward Four, of the Corporation of the Township of Scugog; I' AND WHEREAS an objection was received with respect to the j I boundaries of the Environmental Protection (EP) Zone in part of li Lot 14, Concession 9, Ward Four, of the Corporation of the I Township of Scugog as set forth under By-Law No. 75-80, as amende II by By-Law No. 72-81; AND WHEREAS the Council of the Township of Scugog referre I� the matter to the Provincial Ministry of Natural Resources for a further report as to the boundaries of the Fnvironmental i Protection (EP) Zone in that part of Lot 14, Concession 9, Ward Four, north of Regional Road No. 57; AND WHEREAS the Council of the Corporation of the Town- ship of Scugog has reviewed the report recently prepared by the Ministry of Natural Resources and considers it reasonable to �I further amend By-Law No. 75-80, as amended by By-Law No. 72-R' with respect to the delineation of the boundaries of the Environmental. Protection (EP) Zone in part of Lot 14, Concession ; i j 9, Ward Four, of the Corporation of the Township of Scugog; i NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SCUGOG Enacts As Follows: ,I 1. THAT Schedule 11A311, the Zone Map attached to and forming ii part of Restricted Area By-Law No. 75-80, as amended by By- ' Law No. 72-81, is hereby further amended by rezoning those lands forming part of Lot 14, Concession 9, Ward Four, as ! delineated on the Zone Map attached hereto as Schedule "A" !� and forming part of this " r-Law, from the Environmental Protection (EP) Zone to tick, Rural (RU) Zone. t i !i 50 2. THAT Schedule "A3", the Zone Map attached to and forming i part of Restricted Area By-Law No. 75-80, as amended by By- s I �I Law No. 72-81, is hereby further amended by rezoning those ;I lands forming part of Lot 14, Concession 9, Ward Four, as ! delineated on the Zone Map attached hereto as Schedule "A" it j and forming part of this By-Law, from the Rural (RU) Zone to the Environmental Protection (EP) Zone. 3. THAT this By=Law shall come into force and effect on the date it is passed by the Council of the Corporation of the Town- i. ship of Scugog, subject to the approval of the Ontario ! Municipal Board.
