SUBJECT: BY-LAW NUMBER 33-82: THE CORPORATION
OF THE CITY OF OSHAWA
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-70-82 be received; and
2. That By-law 33-82 of the City of Oshawa be
received and filed.
BACKGROUND AND COMMENT:
By-law Number 33-82 of the City of Oshawa was forwarded to
the Planning and Development Department on April 3, 1982.
The subject By-law rezones a parcel of land on the east side
of Gibbons Street between King and Bond Street West within
the limits of the City of Oshawa. The proposed By-law
amendment would permit the construction of a commercial
shopping centre.

The subject parcel of land is located within an area of
Oshawa which would not have an effect on the Town of
Newcastle and therefore no further action on this By-law
will be required. However, we note that the last date for
filing objections was April 27, 1982.

TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to

apply to The Ontario Municipal Board pursuant to the provisions of Section 39 of
k
The Planning Act for approval of By-law Number 33-82 passed on the 29th day of
March 1982. A copy of the by-law is furnished herewith. A note giving an !
explanation of the purpose and effect of the by-law and stating the lands affected
thereby is also furnished herewith.
ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this
notice, send by registered mail or deliver to the Clerk of the City of Oshawa
i
notice of objection to approval of the said by-law or part thereof giving details
of all or the portion of the by-law to which you object and detailed reasons
i !
therefor, and shall indicate that if a hearing is held the objector or an agent
will attend at the hearing to support the objection.
ANY PERSON wishing to support the application for approval of the by-law may
within twenty-one (21) days after the date of this notice send by registered mail
or deliver to the Clerk of the City of Oshawa notice of his support of approval of
the said by-law together with a request for notice of any hearing that may be held
giving the name and address to which such notice should be given.

THE CNTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it
may appoint a time and place when any objection to the by-law will be considered.
Notice of any hearing that may be held will be given only to persons who have
i
filed an objection or notice of support and who have left with or delivered to the
Clerk undersigned, the address to which notice of hearing is to be sent and
i
similarly, to any person who has filed a request for a change in the provisions of
I
the by-law.
THE LAST DAY FOR FILING OBJECTIONS WILL BE APRIL 27TH 1982

being a by-law to further amend By-law Number 3415 of the City of
Oshawa.
BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law
f
of The Corporation of the City of Oshawa by the Council thereof as
follows: j

I1. That By-law Number 3915 as amended is hereby further
l amended by amending Schedule "A" thereof by adding Special
Condition 109 as set out in Schedule "B" to this 11y-laW.
2. Sheet Number 4 of Appendix "A" to By-law Number 3415 as
amended, is hereby further amended by changing the land use
designation for a parcel of land located on the east side of
{
Gibbons Street between King Street West and Bond Street West,
having approximately 55 metres of frontage on Kinq Street Wost and
Bond Street West and a depth of approximately 83 metres on Gibbons
Street as shown hatched and marked with the figure "109" encircled
on the Sheet Number 4 attached hereto as Schedule "A" in part from
R-3 to C-1 subject to Special Condition "109" and in part from C-1

to C-1 subject to. Special Condition "109" so that Sheet Number 4 i

shall be amended as shown on the revised sheet. Number 4 att',,•hod
hereto as Schedule "A".

3. Schedules "A" and "B" attached hereto form part of this
by-law.
4. The lands made subject to Special Condition 109 are j
hereby declared to be a site plan control area within the meaninq
of Section 40(2) of The Planning Act, R.S.O. 1980, C. 379 as
amended.

5. Paragraph 4 of this by-law shall take effect from the {!
date of passing of this by-law. No other part of this by-law !
shall come into force without the approval of The Ontario

Municipal Board but subject thereto this by-law shall take effect

from the date of its passing.

SPECIAL CONDITION 109
A parcel of land located on the east side of Gibbons Street
i
between King Street West and Bond Street West as shown on
jSchedule "A" hatched and marked C-1 with the fiqures "109"
encircled shall be subject to the special provisions and
definitions hereinafter contained and where there is any i
conflict between the provisions and definitions hereinafter
set out and any other provisions and definitions of- lty-law
3415 and By-law Number 55-73, these special provisions shall j
I
apply, but in the event that this Special Condition is silent
on any matter, the provisions and definitions applicable to a
C-1 use district and Bye-law Number 55-73 shall apply:

1.1 Defined Area: i

The area subject to this Special Condition is shown on
i
Schedule "A" hereto, outlined with a heavy line and
hatched with the figures "109" encircled.

1.2 Definitions:

For the purpose of the interpretation of various
provisions set forth in this by-law the f.ollowinq
definition shall apply.

1.2.1 "Personal Service Shop", means a building or part
of a building in which persons are employed in
i
furnishing services and otherwise administering
to the individual and personal needs of persons,
and without limiting the generality of the
I
foregoing may include such establishments as
i
barber shops, beauty parlors, shoe repair and
ii
shoe shining shops, dry cleaning establishments !
and depots for collecting dry cleaning and
i
laundry, j

1.3 Permitted Uses: j

The land subject to this Special Condition shall not he c
used for any purpose except one or more of the

following uses: I

1.3.1 Art, music, nursery or commercial school.
1.3.2 Art gallery,
1.3:3 Bank.
1 .3.4 Office buildings and offices, except
veterinary offices.
1.3.5 Order office or agency.
1.3.6 Personal service shop.

1. 3.7 Radio or television broadcasting station or

studio.

1. 3.8 Restaurant.
1.3.9 Retail Store

1.3.10 Tavern or public house.
1.3.11 Workshop accessory to a retail store and F
located on the same lot therewith and having
a floor area equal to not more than twenty C
(20) per cent of the selling area of the
retail store.

1.3.12 Self-service automatic launderette.
1.3.13 Shopping centre containing only the foregoing
uses.

1.4 Permitted Buildings
One single-storey building having a maximum building

area of 1500 m2 is permitted. i

1.5 Off Street Parkinq and Loadinq:

Off street parking and .loading spaces shall he provided j
i
as follows:

1.5.1 A minimum of sixty-six (66) off-street
parking spaces shall be provided.
1.5.2 No loading spaces are required to be
provided.

1.5.3 Aisle widths shall be a minimum of 7.2m.

1.6 Front Yard Depth:
The minimum front yard depth from Bond Street West

shall be 2.4m.

EXPLANATORY NOTE
EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 33-82
By-law Number 33-82 changes the land use designation for a parcel
of land on the east side of Gibbons Street between King Street
West and Bond Street West having a frontage of approximately
fifty-five (55) metres on King Street West and Bond Street West
and a frontage of approximately eighty-three (83) metres along
Gibbons Street from R-3 and C-1 to C-1 subject to Special
Condition 109 to permit the construction of a commercial shopping
centre.
