SUBJECT: GROUP HOMES - BY-LAW 81 -154
FORMER TOWNSHIP OF CLARKE

RECOMMENDATION:
It is ,respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-61-82 be received; and
2. That the attached draft By-law which would have
the effect of repealing By-law 81-154 in its
entirety be forwarded to Council for approval ;
and
3. That the Ontario Municipal Board be advised of
Council 's actions and that the Ontario
Municipal Board be requested not to approve
By-law 81 -154, but rather to close their file
on this application.

BACKGROUND:
As Committee Members may recall , By-law 81-154 was part of a
package of by-law amendments which were designed to define
Group Homes and to recognize existing Group Homes as
permitted uses. As a result of Council 's adoption of the
recommendations contained in Report PD-17-82, By-law 81-154
was forwarded to the Ontario Municipal Board for approval
notwithstanding the one letter of objection which had been
received. Application to the Ontario Municipal Board for
approval of By-law 81-154 was made by the Town Clerk on
February 10th, 1982.
COMMENTS:
Following the submission of By-law 81-154 to the Ontario
Municipal Board, staff and Council became aware that local
concerns and possible objections to the approval of By-law
81-154 extended beyond the one objection originally received
during circulation. As a result, Council had requested, in
effect, that By-law 81 -154 be held in abeyance by the
Ontario Municipal Board until such time as Council had given
the objections further consideration.
Following therefrom, on March 18th, 1982, staff met with
Mrs. Cunningham and Mr. Burns representing the Stephenson
Road Ratepayers Group, to discuss the subject By-law and
their concerns. As a result of those discussions, it
appeared to staff that many of the concerns could not be
resolved through amendment to the subject By-law, insofar as
they pertained to matters beyond the Municipality's
jurisdiction. However, in light of recent discussions with
the Children's Aid Society, staff have been made aware of
the fact that the Society now plans to close the Group Home,
subject of By-law 81-154 and to sell the property.

In view of this proposed course of action by the Children's
Aid Society and the concerns voiced by the residents of the
Stephenson's Road area, staff are now recommending that
By-law 81 -154 be repealed in its entirety.
Staff note that as a result of this action, there will be no
definition of "Group Homes" provided within the By-law for
the former Township of Clarke, nor will there be any
provisions which would permit the establishment of Group
Homes within said By-law. In that regard, staff will , at
some time in the future, be bringing forward a necessary
amendment to the Clarke By-law to provide for the future
rezoning of properties where Group Homes are being proposed,
in a form consistent with those By-laws presently approved
within the Municipality which deal with Group Homes.
Failing that, staff shall be further reviewing the matter
during the preparation of the Comprehensive Zoning By-law
for the Town of Newcastle, bearing in the mind the concerns
that have been identified during our most recent review of
this matter.

BY-LAW NUMBER 82-51
being a By-law to repeal By-law 81-154 in its entirety; By-law 81-154
being a By-law to amend By-law 1592 of the Former Township of
Clarke.
WHEREAS the Council of the Corporation of the Town of Newcastle has
considered a number of objections to the approval of By-law 81-154;
AND WHEREAS the Council of the Corporation of the Town of Newcastle
has been advised that the lands affected by By-law 81-154 shall no
longer be used for a Group Home;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. By-law 81-154 is hereby repealed in its entirety.
BY-LAW read a first time this 26 day of April 1982
BY-LAW read a second time this 26 day of April 1982
BY-LAW read a third time and finally passed this 26 day of
April 1982.
