SUBJECT: BY-LAW NUMBER 10-82
THE CORPORATION OF THE TOWNSHIP OF SCUGOG
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-51-82 be received; and
2. That By-law Number 10-82 of the Township of
Scugog be received and filed
BACKGROUND AND COMMENT:
By-law 10-82 of the Township of Scugog was forwarded to the
Planning and Development Department on March 15, 1982. The
subject By-law is an amendment to Restricted Area By-law No.
75-80, being a comprehensive zoning By-law for the former
Township of Scugog. This By-law amendment 10-82 rectifies
the several objections which had been received through the
circulation of the comprehensive By-law in terms of
clarifying the delineation of the boundary of the
Environmental Protection (EP) Zone.

Therefore, since this amendment affects lands within the
Township of Scugog which would not have an effect on the
Town of Newcastle, then no further action on this By-law
would be required. However, we note that the last date for
filing objections was April 2, 1982.

by The Corporation of the Township of Scugog for
approval of a by-law to regulate land use passed.
Pursuant to Section 39 of The Planning Act.
TAPE NOTICE that the Council of the Corporation of the Township of Scugog
-intennds to apply to The Ontario Municipal Boird pursuant to the provisions
of.Section 3 .of The Planning Act for approval of By-La ff 10-82 passed
on the 8th day of March 1982. A copy of the by-lava is furnished
herewith and a note giving an explanation of the .paarpaise laid effect of the
bY-law .sand stating the lands affected thereby is also furnished herewith.
ANY PERSON INTERESTED MAY, within twenty-one (21) days ;after the.d,ste of
this notice;, send bl� registered mail or deliver to the clerk of the Town
ship of Scugog notice of objection to approval of the said by-law or part
thereof giving details of all or the portion of the Tay-law to which
you

ANY pE wishing to saapport the' application for approval of the by-law
y within 'twenty-one (21) days after the. date of this notice send. by
registered_ mail or deliver to the clerk .of the Township of Scugog notice
of his support of approval of the said by-law together'with a request
for notice of any. hearing that maybe held giving also the name and
address to which such notice should be given.

EXPLMATORY NOTE
PURPOSE OF By-LAW
The purpose of the attached_By-law is to amend Restricted Area By-law too. .75-80,
the comprehensive zoning By-lair for the Township of Scugog. Upon circulation of
By-law ado. 75-80 several objections were received from ratepayers with regards
to the boundary delineation of the Environmental Protection- (EP)' Zone. Council
upon-reviewing the said objections referred same to the Ministry. of Natural
Resources for their review and co gent. This amendment to By-lair No. 75-80 revises
the boundary of the Environmental Protection (EP) Zone in various specific areas
throughout the Township of Scugog in accordance with the comments of the Ministry
of Natural :.Resources,
LOCATION OF LANDS AFFECTED
The lands affected .by this amending Bylaw are generally described as follows-,
A. part of sots 13 and 14, Concession 8, Ward Ore;
i.i. part of Lots ld and 14., Concession' 12, Ward One;
iii. part of Lots 8, 9 and 10, Concessi€nsll .and 12g, Ward Three;
iv. part of Lots 11 and 12, Concession 7, Ward Four;
v. part of Lot 12, Concession 3, Ward Fours
vi. . part: of Leas 16 and 17, Concession 3, Ward Four; and,
vii. . part of Lots 20, 21 , 22, 23 and 24, Concession One, Ward Four.
Reference should be made to Schedules "A!" to "A-7" of the attached By-law
to determine the specific lands, affected. -
EFFECT OF 8V-LAW
The effect .of the attached By-law is to clarify the delineation of the boundary
of the Environmental Protection CEP} Zone in those areas specified above. In.
each instancy the By-law serves to rezone the lands within the appropriate zone
classification taking into consideration the reports and comments received from
the Ministry.of Natural Resources. Reference should be made to the text of the
amendment to determine the effect of the By-law with respect to each of the areas
so affected.

RESTRICTED AREA BY-LAW NO. 10-82
BEING A BY-LAW PASSED PURSUANT TO THE
PROVISIONS OF SECTION 39 of THE PLANNING
ACT, R> S. o. 1980 , c. 379 , AS AMENDED; TO
I. APPEND RESTRICTED AREA BY-LAW NO., 75-90,
AS OTHERWISE AMENDED.
WHEREAS the Council of the Corporation of the Township
of Scugog enacted Restricted Area By-Law No. 75-8.0, being the
Comprehensive Zoning By-L.a.w, on January 26, 1981 , to regulate
the use of lands and the character, location and use of
buildings and structures within the whole of the Municipality;
AND WHEREAS various ratepayers within the Corporation
of the Township of " Scugog raised an objection to the zoning of
all or a portion of their rands within an Environmental
( Protection (EP) Zone whereu.nder no permanent" buildings or
E structures are permitted, save and except those existing on the
date of passing of By-Law No , 73-8€3 or as may otherwise be
specifically- referred to under Section 4 . 1 . 1 of the afarementioned
ii By-Late;
AND WHEREAS the Council of the Corporation of he
Township of Scugog referred such objections to the Ministry of
Natural Resources for furtx�er review and "comment ;
AND WHEREAS the Council of the Corporation df the
Township of Scugog has received and carefully con$idered the
comments of the Ministry of Natural Resources and further
considers it advisable to amend By-Lana No . 75-80 with respect to ;:
`+ the delineation of the boundaries of the Environmental Protection

(EP) Zone in accordance with the recommendations of the said

Ministry;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF SCHCCC Enacts As Follows :
1 . That Schedule "A31' , the Zone Map attached to and forming
T part of Restricted Area By-Law No . 75-80, as otherwise
amended , is hereby further amended by re-zoning those lands
forming part of Lots 29; 2l , 22 , 23 and 24, Concessions 1
and 2, Ward Four, as delineated on the Zone trap attached
hereto as Schedule "A-114 and forming part of this By-Law,
from the Environmental Protection CEP) Zone to the Rural
CRU) Zone .

2 . THAT Schedule IIAPI the Zo nle trap attached to and forming

amended, is hereby IE-urther amended by rezoning those _lands
j forming part of Lots 16 and 117 of Concessions 3 and 4 , Ward

Environmental Protection (EP) Zone to the Rural (RU) Zone.
3. THAT Schedule F4A311 , the Zone Map attached to and forming
part of Restricted Area By-Law No . 75-80, as otherwise
amended, is hereby- further amended. by rezoning those lands
forming part of Lot 12 , Concession 3, Ward Four, as delin-
eated. on the Zone Map attached hereto as Schedule "A-341 and
forming part of this By-Law, from the Environmental Protect_c

forming part of Lot 13, Concession 12 , Ward One, as
delineated on the Zone Map attached hereto as Schedule

amended, is hereby further amended by rezoning those lands
forming part of Lots 13 and 14 , Concession 8, Ward One,

"A-7" and forming part of this By-Law, from the Environmental

10. THAT the By-Law shall come into full force and effect on the
date it is passed by the Council of the Corporation of
the Township of Scugo-g, subject to the approval of the
Ontario Municipal Board.
