(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF APRIL 5, 1982 REPORT NO. : PD-50-82 SUBJECT: BY-LAW NUMBER 11-82: THE CORPORATION OF THE TOWNSHIP OF SCUGOG RECOMMENDATION: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report PD-50-82 be received; and 2. By-law Number 11-82 of the Township of Scugog be received and filed. BACKGROUND AND COMMENT: By-law 11-82 of the Township of Scugog was forwarded to the Planning and Development Department on March 15, 1982. The subject By-law rezones a parcel of land located in Part of Lot 16, Concession 5 in the Township of Scugog for the purposes of a motor vehicle dealership, a motor vehicle repair garage and for the sale and service of motorized mobile homes, tourist trailers, tent trailers, truck campers, or other similar recreational vehicles. nV i Jsch Report No. : PD-50-82 . ../2 Since the subject parcel of land is situated within an area of the Township of Scugog which would not have an effect on the Town of Newcastle, then no further action on this By-law would be required. EXPLANATORY-NOTE PLTIPOSE OF BY-LAW: The purpose of the attached By-law is to amend Restricted Area By-law No. 75-80, 08 comprehensive zoning By-law, of the Corporation of tie Township of Scugog as enacted by Muncil on January 26, 19M The By-law serves to amend tie provisions of the Special Purpose Commercial Exception Se.ven (94-7) Zone which presently serves to restrict the uses permitted to that of a motor vehicle 6ealership in the area so zoned. LOCATtON OF LANDS AFFECTED: The lands affected ty this By-law are located S' par=t of Lot 16'' Concession 5, Ward One. The subject property fronts upon the more northerly limit of Provincial Higway No. Kimmediately west of the Port Perry Urban Area. EFFECT OF AMENTINGM-LAW: The effect of this amendment to By- law No. 75-80, specifically Section 4.20.6.7, the Special Puryse Commercial Exception Sev, (0-7) Zone, is tb allow the use of the p •opeity in question for the purposes of a motor vehicle dealership, a motor vehicle repair garage and the sale and service of motorized mobil, homes, touris�_ trailers, tent trailErs, truck campers, or other similar recreational vehicles. The effect of the By-law A therefore to recognize the existing uses made of the lands under consideration. if THE CORPORATION OF THE TOWNSHIP OF SCOGOG RESTRICTED AREA BY-LAX NO. 11-82 BEING A BY-LAW PASSED PURSUANT TO THE PROVISIONS OF SECTION 39 OF THE PLANNING ACT, R. S.O. ,. 1980, c. 373, . AS AMENDED TO I` AMEND RESTRICTED AREA BY-LAW NO. 75-80. WHEREAS the Council of the Corporation of the Township of 'Scugog has received a request to. amend Restricted Area By-Law I _ No. 75-80 insofar as is necessary to revise the provisions of the. Special Purpose Commercial Exception Seven (C4-7) Zone as it applies to those lands forming part of Lot 16, Concession S , Ward One, adjacent the northerly limit of Provincial Highway No, 1 j 7A; so as to recognize the sale and service of recreational vehicles and trailers in addition to those uses which are presently in existence being a motor vehicle dealership and " motor vehicle repair garage; ? AND. WHEREAS the Council of the Corporation of the Township of Scugog has reviewed the request and considers it treasonable to .amend By-Law No . 75-80, as otherwise amended, { it specifically the Special Purpose Commercial. Exceptions Seven (C4-7) t Zone, to specify a motor vehicle dealership, a motor vehicle repair garage and the sale and service of motorized Mobile homes, tourist trailers , tent trailers, truck campers and other similar recreational vehicles as the principal permitted uses; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE !j TOWNSHIP OF SCUGOG Enacts As Follows : t i 1 . That Section 4. 20. 6. 7, Special Purpose Commercial Exception i Seven (C4-7) Zone, of Restricted Area By-Law No. 75-80, be and the same, is hereby amended by inserting the words ii "a motor vehicle repair garage and the sale and service of motorized mobile homes, tourist trailers, tent trailers , truck campers or other similar vehicles" such that the said i Section reads as follows : i84 . 20. 6 . 7 SPECIAL PURPOSE COMMERCIAL EXCEPTION SEVEN (C4-7) ZONE Notwithstanding the uses permitted within the Special Purpose Commercial (C4) Zone, as set forth under Section 4. 20. 1 hereof to the contrary, within the Special Purpose it Commercial Exception Seven (C4-7) Zone, as delineated on the Zone Map attached hereto as Schedule "Al" and forming part it of this By-Law, the uses permitted shall be restricted to i, that of only a motor vehicle dealership, a motor vehicle repair garage, and the sale and service of motorized mobile homes , tourist trailers, tent trailers, truck campers or other similar recreatio-nal vehicles together with such othei 2 ordinate thereto> all other respects the provisions o r Special Purpose Commercial (C4) Zone shall apply and be complied with. " 2. That this By--Law shall come into . full .force and effect on - v date it is passed by the Council of the Corporation of the Township of Scugog.
