REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF FEBRUARY 22, 1982
REPORT NO. : PD-31-82
SUBJECT: BILL 194, PLANNING STATUTE LAW AMENDMENT ACT,
1981
File: PLA-1 .1
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-31 -82 be received for information.
I
BACKGROUND:
On February 1st, 1982, Council received a correspendence item
from the Ministry of Municipal Affairs and Housing in respect
of Bill 194 which was referred to staff for their review and
a report.
Bill 194 is complimentary to the proposed new Planning Act,
i
Bill 159, and will make two amendements to the Municipal Act.
The first, to delete the Sign Regulation provisions which are
contained in Section 40 of the new Planning Act, and the
second, to re-enact in the Municipal Act in a substantially
revised form, Sections 46 and 47 of the present Planning Act,
dealing with various aspects of municipal building by-laws.
These provisions will continue to be superseded where
I
provisions of the Building Code Act apply as provided for by
Section 26 of the Building Code Act, 1974. Bill 194 will
I
Report No. : PD-31 -82 . . ./2
also delete all specific provisions in the Regional
Municipality of Durham Act related to planning matters, since
these Sections have now been incorporated within the new
Planning Act. It would therefore appear that Bill 194 is
simply intended as a "housecleaning" Bill , and as such its
approval would have no implications to the Town of
Newcastle.
Respectfull s itted,
T. T. Edwards, M.C.I .P.
