SUBJECT: PROPOSED SUBDIVISION AGREEMENT, NEW__CASTLE
SHORELINE PROPERTIES, DRAFT APPROVED PLAN OF
SUIM PART OF LOT 25, B.F.
CONC., FORMER VILLAGE OF NEWCASTLE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . That Report PD-29-82 be received; and
2. That the attached Subdivision Agreement between
Newcastle Shoreline Properties Limited and The
Corporation of the Town of Newcastle be approved for
execution; and
3. That the attached By-law authorizing the execution of
an Agreement between Newcastle Shoreline Properties
Limited and The Corporation of the Town of Newcastle be
passed; and
4. That the Town Clerk and Mayor be authorized to execute
the subject Subdivision Agreement upon payment of all
monies due under the terms of the Subdivision Agreement
and upon final O.M.B. approval of the implementing
zoning by-law number 81-66.

BACKGROUND AND COMMENTS:
Application for plan of subdivision 18T-78006 was draft plan
approved by the Minister of Housing on April 14th, 1980. The
approved plan proposed the development of a 6.5 hectare
parcel of land located within part of Lot 25, Broken Front
Concession, former Village of Newcastle and would result in
the development of seven estate residential lots between the
Lake Ontario waterfront and Lakeshore Road.
Among the conditions of draft plan approval for the subject
plan were the requirements that the land be appropriately
zoned and that the Applicants enter into a Subdivision
Agreement with the Town. On March 1st, 1982, the Ontario
Municipal Board will consider the Town's request for approval
of By-law 81-66, which will have the effect of zoning the
subject lands to permit the proposed development. The
attached Subdivision Agreement, the preparation of which has
been the subject of considerable staff review and revision,
fulfills the second requirement referred to above, addresses
the conditions of draft plan approval and safeguards the
Town's, The Ganaraska Region Conservation Authority and the
Ministry of Natural Resources ' interests in respect of the
development of this site. To that end, specific provisions
have been included within the agreement to ensure that the
Ministry of Natural Resources and The Ganaraska Region
Conservation Authority will be satisfied. The attached
agreement has been signed by the Applicants and incorporates
all revisions requested by staff.

It would now be appropriate for Council to execute the
subject Agreement upon payment of all monies due under the
terms of the Agreement and upon O.M.B. approval of the
implementing zoning by-law, 81-66.

being a By-law to authorize the entering into of an Agreement with
Newcastle Shoreline Properties Limited.
The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
1 . THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal , an Agreement between Newcastle Shoreline
Properties Limited and the said Corporation dated the 10th day of
March, 1981 , in the form attached hereto as Schedule 'T'.
2. THAT Schedule 'T' attached hereto forms part of this
by-law.
