(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF FEBRUARY 8, 1982 REPORT NO. : PD-23-82 SUBJECT: REQUEST BY THE CANADIAN IMPERIAL BANK OF COMMERCE FOR THE CLOSING AND CONVEYING OF A PORTION OF SABRA STREEET, HAMLET OF ORONO RECOMMENDATIONS: It is respectfully recommended that 1 . Report PD-23-82 be received; and i 2. That the Canadian Imperial Bank of Commerce request for the closing and conveying of part of Sabra Street in the Hamlet of Orono and conveyance of a further 15' strip of land adjacent to the west property boundary of the CIBC lands be approved; and 3. That staff prepare the necessary by-laws for closing Sabra Street and the short section of Water Street connecting Sabra Street to Station Street; and 4. That the CIBC be advised that this approval is given on the understanding that the CIBC will fulfill the conditions of conveyance outlined in a letter dated December 22, 1981 from their agent, Mr. D. Mills, I Architect, which conditions shall form a portion of the requisite Site Plan Agreement. �O) i y 5-0) Report No. : PD-23-82 Page 2 BACKGROUND & COMMENTS: In July of 1981 -the Canadian Imperial Bank of Commerce indicated an interest in purchasing a portion of the Sabra Street road allowance located on the west side of Mill Street in Orono. See attached sketch. This request was the subject of staff report P-147-81 which recommended that the request be denied. Said report was considered by the Public Works Committee at its meeting of September 15, 1981 and was referred to staff for discussion during the Site Plan approval process. Subsequently staff and the Site Plan Committee have met with the applicants and their agent to discuss the details of their proposal and the implications of it upon Sabra Street. Our review indicated that in order to accommodate the desired building and requisite parking at least a portion of the Sabra Street road allowance would be required. As a result, the CIBC would now like to purchase a 15 foot strip of land abutting the south and west boundaries of their property rather than the entire Sabra Street road allowance. This would result in the Town retaining ownership of a 25 foot wide strip of land within the Sabra Street road allowance, maintaining public access to Town owned lands to the west and ensuring continued access to privately owned lands to the south. In consideration of the Town granting this request the CIBC has indicated that they will provide a paved access within the remainder of the right-of-way and undertake necessary landscaping improvements thereto. In view of the verbal agreements reached with the CIBC in respect of the site's development and the pending site plan i i Report No. : PD-23-82 Page 3 approval staff would have no difficulty in recommending that a portion of Sabra Street be closed and conveyed to the CIBC and that a further 15 foot strip of land also be conveyed to facilitate a more appropriate site development than that which can be undertaken within the constraints of the present property boundaries. Imperial Bank of Com.nerce _ Orono Ontario Dear Sir: Further to our recent neeting December 8, 1981 , the Canadian Imperial Bank of Co.n:nerce is interested in obtaining additional land when Sabra Street is closed . The reasons for developing this land were indicated in my earlier letter of October 16 , 19$1• It is our opinion that this proposal will be a benefit to the Town of Orono. We confirm the following conditions of conveyance as discussed and agreed to at our aforementioned meeting. ( See Site Plan attached, dated December 21, 1981. a) property The Town convey a 15 ft . strip on the south and west boundary of ro P P y ( Part A) . i b) The Town will confirm their intention to retain the 25 ft . strip ( Parts B and C) . C) The Bank will provide a paved surface access adjacent to the southern boundary of the C. I.B. C. ° s property , which will in future be utilized by the public as an entry to Town owned property . ( See Landscaping Part B) . d) The paved access will extend approximately 120 ft . adjacent ' to the southern boundary of Banks property. e) The Bank agrees to g provide paving and sodding only on the re naining 25 ft . ( Parts B and C) . i f ® 2 .. f) The Town will be responsible for all maintenance and repairs associated with the paved accessway and land- scaping after takeover by the Town of Newcastle . g) The Bank agrees to arrange for a reference plan to be : i prepared, illustrating the property to be conveyed by the Town , once approval is given by Council. }�+"I h) The Bank would like to be represented when the ro osal is considered at Council meetings. p p If required, we are available to attend any additional meetings to explain this proposal.
