(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF FEBRUARY 8, 1982 I REPORT NO. : PD-18-82 SUBJECT: OBJECTION TO BY-LAW 81 -172 PART OF LOT 11 , BROKEN FRONT CONCESSION, BOWMANVILLE EDWARD AND GLORIA NOSEWORTHY File: Z-A-2-13-2 i RECOMMENDATIONS: 1 . Report PD-18-82 be received; and 2. That the General Purpose and Administration Committee recommend to Council that the following resolution be adopted and forwarded to the Ontario Municipal Board: "WHEREAS the Council of the Town of Newcastle has approved By-law 81-172 amending Restricted Area By-law 1587, as amended, pursuant to their consideration of an application for such an amendment, submitted by the affected property owner; AND WHEREAS the intent of By-law 81 -172 was to recognize an existing use; AND WHEREAS the Council of the Town of Newcastle has received an objection to the approval of By-law 81 -172; AND WHEREAS the Council of the Town of Newcastle is satisfied that the proposed By-law is in conformity with the Durham Regional Official Plan in that the Official Plan allows a Municipality to recognize an existing use; d 7 -�. go Report No. : PD-18-82 . . ./2 I i BE IT NOW RESOLVED that the Town of Newcastle hereby requests the Ontario Municipal Board to approve By-law 81-172, and hereby authorizes j Planning staff and the Town Solicitor to attend any hearing that may be convened in respect of j the By-law on behalf of the Town. " BACKGROUND AND COMMENT: Town Council approved By-law 81 -172 on October 19, 1981 rezoning a 1317.0 square metre (14,175 square feet) parcel of land located in Lot 11 , Broken Front Concession, Bowmanville to recognize the existing use of the property as a single family residence and an accessory building. As a result of the circulation of the By-law, one objection was received (copy attached) . The objector is apparently concerned that the subject By-law is in fact rezoning his lands, and as a result would affect his existing bee operation. Staff note that the By-law does not in any way rezone Mr. Dewey's property which is located approximately 350 feet north of the lands affected by the subject By-law amendment. In this regard, staff feel that the rezoning, while allowing the continuation of the existing uses of these lands, does not represent a serious problem for this area. Therefore, staff recommend that the By-law be forwarded to the Ontario Municipal Board for approval with the resolution contained within the recommendation. Respectfully sub)nittpd; f � T. T.
