REPORT NO.: PD-12-82 Subject: Preliminary Industrial Subdivision Proposal Part Lot 30, Concession 1, former Township of Darlington G. C. Jain File No. : S-A-1-5-3 Recommendation: It is respectfully recommended:- 1. That this report be received by the Committee; and 2. That the applicant be advised that the Town of Newcastle is prepared to provide favourable recommendations on a formal subdivision application similar to the draft pro- posal in question; and 3. That the applicant be advised that a formal subdivision application should be submitted to the Regional Munici- pality of Durham. Background: On December 21st. , 1979, the Town of Newcastle received a prelim- inary proposal for an industrial sudivision located within part of Lot 30, Concession 1, former Township of Darlington. These lands are designated "Agricultural" in the Darlington Official Plan, however, the Durham Regional Official Plan designates the property "Industrial". As in all cases of conflict, it is the Regional Plan designation and policies which prevail. The proposal appears to be in conformity with �e Report No. : PD-12-82 . . . .2 / the Regional Plan. Piped services are not available to the site, and as such, only those industrial uses of a "dry" nature would be permitted. As required by Section 8.4.3.3 of the Regional Plan, an engineering report dealing with site suitability for individual services was submitted in support of this application. Study results suggest that, although the site is generally suitable for industrial development, the existing soils are not considered suitable for conventional septic waste disposal systems, and there does not appear to be an adequate supply of potable ground- water available on site. Pursuant to the Department's procedure for processing subdivision applications, the subject proposal was circulated to a number of agencies for review and comment. Comments received have been sumarized as follows: Region of Durham Planning Department Comments received from the Durham Region Planning Department indicate that the draft proposal appears to conform to the Regional Plan, notwithstanding that piped services are not available and that potable water may not be available on site. Regional Planners indicate,however, that their comments on conformity must be qualified by limiting the uses to "dry industry". In addition, the proposal is only considered in conformity if the method of providing adequate potable water to the site is acceptable to the Town and the Durham Health Unit. Durham Regional Health Unit: The Regional Health Unit has indicated that based on the in- formation provided, the lands in question are not well suited for the installation of conventional septic tank disposal systems. They have however, offered no objection on this basis. They point out that it is difficult to ascertain what type of disposal systems, if any, could be utilized in the area until more information is available as to the size and use of buildings, the number of employees, etc. Report No. : PD-12-82 3 The Health Unit has participated in discussions with the Town, the applicant and the Regional Planning Department on the question of potable water supply. They recognize that it is unlikely that potable water can be found on site. However, they have indicated a willingness to tentatively approve the provision of storage tanks for drinking water. Newcastle Fire Department: "l. Underground water -reservoirs-for fire--protection should be provided in commercial and industrial areas not serviced by piped water systems. 2. In general the reservoirs should be located accessible from the travelled portion of a road or driveway, con- crete design, 3 feet below grade level, tank depth max- imum 15 feet, capacity 30,000 gallons well casing, 3 ft. opening, 10 inches above grade level, concrete lid and ring, 4 inches thick. 3. Buildings- Fire Safety Design Standards in accordance with occupancy. " Newcastle Public Works: "l. That the owner enter into a Development Agreement with the Town, and that this Department be kept informed of the status of same at all times. 2. That all works are completed in accordance with the Town of Newcastle's Design Criteria and Standard Drawings. 3, That any easements required by the Town be granted free and clear of any encumberances. 4. That a 10 (ten) foot road widening be granted to the Town, along the north side of Baseline Road. 5. That the owner meet all the requirements of the Public Works Department, financial and otherwise. 6. That the owner enter into a Cost Sharing Program with the Town in respect of reimbursing the property owners who provide access to the applicant's lands. Comments: Based on the information provided and the comments received, staff beleive that, despite certain servicing limitations, the proposed sub- division is in conformity with the relevant Official Plan guidelines. Report No.: PD-12-82 . . .A As such, staff would have no objection to the proposal once a formal subdivision has been submitted to the Region of Durham. Concerns related to potable water supply, waste disposal and fire protection should be addressed at that time. Appropriate conditions of approval should be imposed and enforced through subdivision and site plan agreements. The following is a summary of the conditions that staff would recommend be applied to the approval of a formal subdivision application in order to address the identified concerns: 1. That the future road allowance in the draft plan be dedicated as a public highway. 2. That the applicable Restricted Area Zoning Sy-law be brought into conformity with the Region of Durham Official Plan and that any necessary amendments be approved and in effect subject to the provisions of Section 35 (10) of the Planning Act, R.S.O. 1970 prior to registration of the plan. 3. That the owner shall enter into a subdivision agreement with the Town of Newcastle to include, in addition to the Town's usual requirements, the following provisions: a) That the owner agrees to satisfy the requirements - of the Health Unit and the Town with regard to the provision of a potable water supply and agrees to satisfy the requirements of the Health Unit with regard to sanitary waste disposal. Report No. : PD-12-82 . . . .5 b) That the owner agrees to satisfy the requirements of the Town with regard to the provision of fire protection facilities which shall specifically include the provision of a water reservoir for fire fighting purposes. C) That a 3 metre (10 ft.) road widening be granted to the Town along the north side of Baseline Raod. d) That all works are completed in accordance with the Town of Newcastle's Design and Standard Drawings. e) That the owner meet all the requirements of the Public Works Department, financial or otherwise including the dedication of all necessary reserves and/or easements. Staff note that at such time as a formal application has been submitted to the Region of Durham a further staff report shall be required at which time the foregoing conditions for draft plan approval shall be expanded upon in greater detail as may be necessary.
