Dallas &0 . :,Sr5q. Part of Lot 14, Concession 8, former Township of Darlington Files: Z-A-1-15-12 & Z-A-1-15-13 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That Report PD-3-82 be received; and 2. That applications for rezoning Z-A-1-15-12 and Z-A-1-15-13 be approved; and 3. That the attached By-law 82-%O be forwarded to Council for approval. Background: The subject applications for rezoning request amendment to Restricted Area (Zoning) By-law 2111 of the former Township of Darlington to rezone two parcels of land, each having an area of .51 hectares (1.265 acres) fronting on King Street in the Village of Haydon. The proposed amendments will be combined as one, and would permit the applicants to erect one single family residence on their respective properties having a lesser floor area than that presently required by By-law 2111, as amended. j` V s�C Report PD-3-82 . ..2 The site is located within the Village of Haydon, a designated "Hamlet" by the Region of Durham Official Plan. The proposed residential uses are permitted within the Hamlet area. In addition, the subject lands are located in an area designated as "Residential Infilling" by the Haydon Development-'Plan. Therefore, the proposed rezoning of these parcels of land conforms with the policies of both the Region of Durham Official Plan and the Haydon Development Plan. The site is presently zoned "D-Deferred Development" by Restricted Area (Zoning) By-law 2111 of the former Township of Darlington. The proposed By-law amendment would apply one "Special Provision" for the two sites and would provide for a minimum gross floor area of 110 square metres (1200 square feet) . In accordance with departmental procedures, the subject applications were circulated to various departments and agencies for comment. The following is a list of the comments received: Region of Durham Planning Department "Please be advised that the subject site is located within Haydon, a designated Hamlet in the Durham Regional Official Plan. The Haydon Hamlet Development Plan prepared in accordance with the Durham Plan policies shows the subject site as "Residential Infilling". The above applications for rezoning conform." Durham Regional Health Unit "No objections". Newcastle Public Works Department "l. The applicant be required to submit a Lot Grading and Drainage Plan for Works Department approval, prior to the issuance of a Building Permit, and that this Plan conform to the Town of Newcastle's Design Criteria and Standard Drawings. . 50 Report No.: PD-3-82 . . . .3 2. That the applicant be required to obtain an approved Entrance Permit prior to the issuance of a Building Permit, and that access be in accordance with the Town of Newcastle's Entranceway Policy and By-law. 3. That the applicant obtain approval from Bell Canada and Hydro Electric Commission for extension of services to the property and that these secondary services be con- structed underground to the house. 4. That the applicant contribute towards the minor upgrading of the road." Newcastle Fire Department "The Fire Department has no objection to the application for rezoning. The area is located approximately 15 minutes emer- gency response time from Fire Station # 1, Bowmanville. Smaller single family dwelling units lend support to more economical energy saving heating costs." Newcastle Building Department "No objection" Comment$ Staff have reviewed the applications submitted by Mr. & Mrs. Enright and Mr. W. G. Dallas and would note that both applicants are requesting permission to construct an 110 square metre (1200 square feet) residence on their respective properties, instead of the presently required 162.5 square metre (1750 square feet) . Since there were no concerns expressed as a result of our circulation of these applications, and due to the fact that the proposals conform to the policies of the Regional Official Plan and the Haydon Development Plan, staff would have no objection to the approval of these applications. Staff also note that a majority of dwelling presently located within Haydon are within the R 3 residential zone. The minimum floor space requirement within that zone is 106.8 sq,m (1150 sq. ft.) ! Report No.: PD-3-82 . . .4 The proposed rezoning would bring the minimum building size into line with that zone and at the same time implement certain provisions of the Hamlet Development Plan respecting minimum lot size. With respect to the comments of the Town's Works Department, staff.. note that certain of their requested provisions cannot be applied owing to the fact that the subject lots are existing residen- tial lots for which building permits are available. We have, however, incorporated a requirement relative to lot grading and drainage owing to existing problems related to drainage in this area. The Works Depart- ment's comment relative to access need not be addressed through the re- zoning since this would be dealt with prior to issuance of building permits. The other comments relative to servicing and contributions towards road improvements would more appropriately have been made at the time of severance and contained within a subdivider's agreement. Since this was not done it would now be an onerous requirement partic- ularly in view of the fact that building permits are presently available for these lots without having to meet these requirements. December 18, 1981 THE CORPORATION OF THE TOWN OF NRWCASTU' By-law Number 82-10 being a By-law to amend Restricted Area By- law Number 2111, as amended of the former Township of Darlington, now in the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law 2111, as amended, of the former Township of Darlington. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows:- 1. Section 13 of By-law 2111, as amended, is hereby further amended by adding thereto subsection (kk) as follows: (kk) Part of Lot 1.4, Concession 8 Notwithstanding any provisions of the By-law to the contrary, that portion of Lot 14, designated "SPECIAL PROVISIONS BY-LAW 82-10 " on the attached Schedule "A" hereto shall be used only in accordance with the following provisions. (i) Permitted Uses (i) one single family dwelling, and buildings and structures accessory thereto. (ii) Notwithstanding any provision of this by-law to the contrary, no person shall use, erect, place, or alter any building or structure or alter any lands within the area subject of this Special Provision until the written approval of lot grading and drainage plans has been obtained from the Town of Newcastle Public Works Department. (ii) Zone Provisions (a) Lot area (minimum) 0.5 hectares (b) Lot Frontage (minimum) 60.0 metres (c) Front Yard (minimum) 10.0 metres (d) Interior Side yard (minimum) 2.5 metres (e) Rear yard (minimum) 10.0 metres (f) Gross floor area (minimum) 110.0 square metres (g) Building Height (maximum) 10.0 metres 2. Schedule "A" to By-law Number 2111, as amended, is hereby further amended by changing to SPECIAL PROVISION BY-LAW 82-10 . the zone designation of the lands indicated as "ZONE CHANGE TO SPECIAL PROVISION BY-LAW 82- 10 " on the attached Schedule "X" hereto. 3. This By-law shall become effective on the date hereof, subject to the provisions of Section 35 (10) of the Planning Act. BY-LAW READ a first time this 18th day of January A.D. , 1982.
