SUBJECT: Letter from Cean Investments regarding proposed Plan of
Subdivision #18T74O67
ORIGIN: Referral from Council

Background:
The applicant proposes the subdivision of a 9.12 acre parcel situated
east of High Street and north of the Canadian Pacific Railway in Bowman-
ville to accommodate nine single family units, eight semi-detached units
and thirty-two townhouses. On May 16, 1977, the Town recommended this
subdivision Plan to the Minister of Housing for approval subject to the
following conditions :
(1 ) THAT Blocks D, G and H be combined as a pedestrian
walkway.

(2) THAT Block E abutting the railway line is conveyed to
the municipality for parkland screening and that it be
graded and landscaped to minimize noise.
(3) THAT a portion of the lands for multi family units

be offered to Ontario Housing Corporation at a price
to be specified in the subdivision agreement not to be
less than that which a knowledgeable private builder would
pay.

(4) THAT authorization to commence work be granted only
when the Durham Commissioner of Works certifies that
sufficient water supply and sewage disposal capacity is
available for the proposed development.
This approval was based on the assumption that development of the
proposed subdivision would proceed only when services were available.
We have been advised by the Region of Durham Works Department that this
site cannot be serviced until the Soper Creek Sewage Treatment Plant
is in operation and until the Sturrock Avenue Booster Station has been
constructed. Since there is currently no provision in the Region's five-
year capital budget for the Sturrock Avenue Plan, there is no guarantee
that the site will be readily servicable even after the Sewage Treatment
Plant has been completed. The Ministry of Housing had been informed of
this situation by the Region's Works Department. Accordingly, on
February 8, 1978, the applicant was advised by the Ministry of Housing
that in light of the fact that the proposed subdivision could not be
serviced in the near future, the proposal is considered premature and
that the Ministy of Housing had closed its file on the subject application
until sewage treatment capacity was imminent.
Comments:
The subject letter requests the Town to re-open its file on the
proposed Plan. Since the Town has already recommended approval of the
Plan, subject to the availability of services, this request should have
been made to the Minister of Housing. However, in view of the fact that
the servicing senario has not changed since the Ministry closed its file,
such a request would appear to be premature.

Recommendation:
It is recommended that the applicant be advised that a request
to re-open this file should be made to the Ministry of Housing, but
that such a request would be premature until the contracts have been
awarded for the Sturrock Avenue Booster Station and the Soper Creek
Sewage Treatment Plant has been completed.
