SUBJECT: Plan of Subdivision Number S-A-1-6-3 (Ministry of Housing
No. 18T-77002) - Part Lot 33, Concession 2, Darlington,
D.R. Agencies (Oshawa) Limited
1 . Background:
We have been advised that Mr. Roy of D.R. Agencies (Oshawa) Limited
will be appearing before the Committee as a delegation to request
approval in principle of his proposed Plan of Subdivision in Courtice.
The Plan proposes the subdivision of a 17.64 acre parcel for ten
single family lots, a 2 acre commercial block and an 11 .79 acre open
space block.
2. Planning Considerations:
The subject site is within the area in Courtice proposed for designation
as "urban area" in the Region of Durham Official Plan. The designations
proposed by the Region of Durham for the site are "major open space--
hazard lands" and "residential area". While the Plan originally pro-
posed a "Type B" arterial road in the vicinity of the proposed develop-
ment, the Region later determined that the road was unnecessary and
requested the Minister to delete the road as a modification to the
Plan.

The proposed Courtice urban envelope was not approved by the
Minister of Housing but was instead deferred for future consideration.
Recently, the designations of this area as well as the proposed
transportation network have been referred to the Ontario Municipal
Board by Progeny Developments Limited. We have been advised that the
Minister of Housing would not be in a position -to approve the pro-
posed Plan of Subdivision until a decision has been made on the
ultimate Official Plan designation of the whole Courtice area.
In addition, Section 8.1 .3.5 of the Region of Durham Official Plan
requires "that Councils of the area municipalities shall be encouraged
to prepare Development Plans as defined in Section 16.5 prior to the
approval of major development applications".
Staff is currently supervising the preparation of a Development Plan
for Courtice.
3. Comments:
If Council considers the proposed Subdivision Plan to be "major
development" , it should not be recommended for approval until the
Courtice Development Plan has been adopted by Council . In the event
that Council considers that the proposed Subdivision constitutes a minor
development, we would not suggest that Council recommend this Plan to
the Minister of Housing for approval . However, we would have no
objections to its approval in principle provided that this approval be
contingent upon the portion of the site proposed for development being
designated "residential aced' by the Ontario Municipal Board and upon

the site being designated for residential development in the
Courtice Development Plan.
