SUBJECT: Report on Application for Plan of Subdivision (preliminary)
Part of Lot 13, Concession 2, Bowmanville (Scugog Street
North of Jackman Road) - Hillwood Investments
1 . Purpose of Application:
On August 31 , 1978 a preliminary application was submitted for approval
of a four lot subdivision on a .526 acre site located on Scugog Street
North of Jackman Road in Bowmanville. This Plan was referred to staff
for a preliminary report on September 26, 1978.
2. Background:
The proposed subdivision is a portion of a Plan which was given draft
approval by the Ministry of Housing on February 14, 1973. In September
of 1973, Bowmanville Council recommended that only the four lots fronting
on Scugog Street be approved. Accordingly, the Town and the applicant
began the process of negotiating a subdivision agreement. Unfortunately,
the standard forms were not available at this time and the agreement was
never finalized. In the meantime, the applicant applied to have the
draft approval, which was scheduled to lapse on February 14, 1976 extended. j
We understand that because the letter requesting this extension was not j
received by the Ministry of Housing until February 16, 1976, the draft
approval lapsed on February 14, 1976. "

3. Official Plan Provisions:
The site is designated "Residential Areas" in the Region of Durham
Official Plan. While residential development is permitted by this
designation, section 8. 1 .3. 1 of the Plan states that "Residential
Areas shall be fully serviced by municipal water and sewage systems
and that this shall be a necessary condition before residential devel-
opment is permitted in any of the designated areas." Since it appears
that services will not be available to the site in the near future,
the proposed subdivision does not appear to comply with the provisions
of this designation.
4. Availability of Services :
We requested comments from the Region of Durham Works Department regarding
the availability of services to the site. The following comments were
received:
"The Regional Works Department has reviewed the above noted proposal
and wish to provide the following information with respect to Regional
services.
1 . Water Supply Plant Capacity
Modifications are presently underway at the Bowmanville Water
Supply Plant and upon completion of these in mid summer, 1978,
additional plant capacity will be available to accommodate
additional development in Bowmanville.
2. Water Distribution Stem
The subject lands are located in the Zone II area of the distribution
system. Further development in this area, due to the pressure
problems experienced by existing development, cannot proceed until
a Zone II Pumping Station and related suction and feedermains are
constructed.
To date the Regional Works Department has no definite schedule
available for the construction of the subject pumping station
and related feedermains.

"3. Water Pollution Control
The existing Bowmanville Plan is extremely limited with respect
to reserve capacity and it is our understanding that the Town
of Newcastle will be advising the Regional Works Department, in
the near future, as to where the remaining capacity is to be
allocated. " (we note that this development was not included
in Council ' s allocation list)
"Additional plantcapacity will not be available until the new
Soper Creek Water Pollution Control Plan is constructed. The
Region is presently involved in acquisition of the land for the
new plant and if this proceeds on schedule is expected that the
plant could be in operation by late 1981 .
4. Sanitary Sewer System
The existing sewer system into which the subject land would drain
has experienced overloading during storm periods, resulting in
basement flooding of some abutting properties.
The Regional Works Department in 1977, as part of the Capital
Budget, determined that the problems in this area could be overcome
by construction of a new sub trunk sewer from Rehder Avenue South
to the existing trunk sewer in Bowmanville Creek.
This particular budget Item No. 77-S47 was considered by Regional
Council and due to existing plant capacity constraints for further
development it was determined that the high cost of constructing the
trunk sewer for the minimal amount of development that could take
place, was uneconomical , therefore Council passed the following
resolution -
RECOMMENDATION TO COUNCIL (AS AMENDED)
THAT Item No. 59, Project No. 77-S47 for the construction of a
sub-trunk sanitary sewer on easement from Rehder Avenue to Waverley
Road in the Town of Newcastle (Bowmanville) be deleted from the
1977 Capital Budget and that the project be reconsidered during
the 1978 Capital Budget discussions. " (we note that the applicant
was subsequently advised by the Region that this diversion sewer will
not likely be constructed during the next five years)
"In conclusion, we wish to advise that due to the servicing constraints
as mentioned herein it is the position of the Regional Works
Department that the proposed plan of subdivison 18T-77102 is pre-
mature at this time. "
5. Comments :
Unless this servicing issue can be resolved, we feel that we have no
alternative but to follow the Region of Durham Works Department recom-
mendation that the proposed subdivision is premature. However, we
suggest that the application be reconsidered once we have been advised

by the Region of Durham that services will be available within the
next two years.
6. Recommendation:
It is recommended that the applicant and the Ministry of Housing be
advised that the subject application is premature at this time and
that the application will be considered again once we have been advised
by the Region of Durham Works Department of the imminent availability
of services. It is also recommended that at such time as we are

advised by the Region of Durham Works Department that services will be
available to the site within the next two years, that the application
be reconsidered and that the application fee be waived.
