SUBJECT: Application for Plan of Subdivision, Part Lot 13, Concession 2,
Bowmanville, Hillwood Investments Limited
On August 31st, 1978, a preliminary application was submitted
for the Subdivision of a site located on Scugog Street north of Jackman
Road in Bowmanville. The applicant is proposing the development of this
site, which comprises .526 acres for four (4) single family lots.
This is a re-submission of a Plan which was given draft
approval by the Ministry of Housing on February 14, 1973. Approval of
the Subdivision lapsed February 14, 1976. The applicant will be present
at the meeting to present the proposed Plan to the Committee for infor-
mation.

We would recommend that staff be authorized to prepare a
preliminary report on this application.

CHEQUE IN THE AMOUNT OF $250.00 AS REQUESTED.
WE WOULD BE PLEASED TO OBTAIN COUNCIL 'S RE—APPROVAL FOR THE DEVELOPMENT
OF THESE FOUR LOTS. PLEASE ALLOW US TO GIVE A SHORT HISTORICAL OUTLINF
REGARDING THIS DEVELOPMENT.
THE COUNCIL APPROVED A PLANNING BOARD RESOLUTION THAT UNTIL FUTURE
MUNICIPAL SERVICES ARE AVAILABLE ONLY LOTS NUMBERED 1 , 2, 3 AND 12 ABUTTING
SCUCOG STREET BE APPROVED FOR DEVELOPMENT. THIS RESOLUTION WAS PASSED ON
SEPTEMBER 10TH, 19V3- THE LOTS NUMBERED 1 , 2, 3 AND 12 ARE NUMBERED 1 , 21
3 AND 4 ON THE ATTACHED NEW DRAFT PLAN.
ON SEPTEMBER 1?TH, 190 MR. G. F. HowDEN, THEN PLANNING DIRECTOR STATED IN
HIS LETTER To MR. H. RAYMOND OUR CLIENT'S SOLICITOR THAT A NEW STANDARD
SUBDIVISION AGREEMENT BE DRAWN UP FOR THE TOWN TO REFLECT THE CHANGES
REQUIRED BECAUSE Or REGIONAL GOVERNMENT. MR. HOWDEN STATED THAT As sowl
AS THESE CHANGES WERE MADE HE WOULD SEND A COPY OF THE SUBDIVISION AGREEMENT
TO MR. RAYMOND.
ON NOVEMBER 25TH, 1974 WE RECEIVED A LETTER FROM THE REGION OF DURHAM
GIVING APPROVAL FOR THE WATERMAIN AS DESIGNED IN SCUCOG ROAD AND WE "AVE
A WATER WORKS APPROVAL FROM THE MINISTRY OF THE ENVIRONMENT DATED
FEBRUARY 2?TH, 19V5. IT SHOULD BE REALIZED THAT AT THIS POINT IN TIME
THERE WAS AN EXISTING G INCH SANITARY SEWER SERVICING THE SITE AS WELL AS
CONTINUED.....

AT REGULAR INTERVALS WE CHECKED WITH IVIR. HOWDEN ABOUT THE PROPOSED
SUBDIVISION AGREEMENT, WHICH NEVER WAS IN AN APPROVED STATE.
ON FEBRUARY NTH, 1)'fu WE REQUESTED EXTENSION OF THC DRAFT PLAN APPROVAL
FROM THE MINISTRY OF HODSINC , WHICH I_-..TTER WAS NEVER RECEIVED, WHICH WAS
APPARENTLY LOST IN "i'NE L1A I L.
ON FEBRUARY 11-ril, 19'7O IVIR. HOWDFN INFORMED US THAT HE HOPED TO HAVE A
SUBDIVISION AGRLIELIENT READY FOR DISCUSSION IN THREE WEEKS OF THAT DATE.
IN JU14E 1976 THE ENGINEERING DRAWING WAS RE •DRAWN TO MEET THE REGIONAL
STANDARDS IN FORCE AT THAT TIME. THE ATTACHED COPIES OF OUP DRAWING 1'J2-BI
WERE APPROVED BY THE REGION ON AUGUST 17Th, 1076.

REGISTERED UNDER LAND TITLES ON SFPTEtA0FR 215T, 1976 AS PLAN N0. 1OR-65o
AS ATTACHED.
SINCE FEBRUARY 19'J7 OUR CLIENT HAS BEEN NEGOTIATING A SANITARY SEWER
EASEMENT WITH PRIVATE PEOPLE ALONG JACKMAN ROAD, TO PROTECT THE FUTURE
SERVICING POSSIHILITICS, FOR NOT ONLY OUR CLIE-HT IS LAND BUT ALSO LANDS 'LO
THE NORTH. SUBSTANTIAL MONIES HAVE BEEN PUT OUT IN THE PREPARATION OF
LEGAL. SURVEY PLANS AND NEGOTIATIONS. AT PRESENT THE AGREEMENT WITH THE
PARTY ON JACKMAN ROAD IS BEING FINALIZED.
A LETTER OF THE TOWN OF NEWCASTLE DATED DECEMBER 12TH, W 7 STATES TI-IAT
IVIR. IIODDENBAGH OF G. T. NORTON & ASSOCIATES LIMITED BE NOTIFIED THAT AS
DRAFT APPROVAL HAS LAPSED THERE IS NO FURTHER OBLIGATION ON BEHALF OF THIS
MUNICIPALITY UNTIL. SUCH TIME AS A RENEWED APPLICATION HAS BEEN SUBMITTED.
