SUBJECT: Restricted Area By-law 79-82
An Amendment to Restricted Area By-law 79-44
for the Former Village of Newcastle
Senior Citizen's Lodge - File Z -A-3-11-4

By-law 79-82 permits the erection of a 43 unit senior
citizen apartment building on Part of Lot 27, Concession 1 of the
former Village of Newcastle.
The by-law was considered by Council at its regular meet-
ing of August 27, 1979 and was adopted at that time.
By-law 79-82 was advertised and notice given to all
property owners within 400 feet of the subject site, as required by
the Ontario Municipal Board Revised Rules of Procedure. As a result
of the By-law circulation, two letters of objection were filed with
the Town Clerk (attached).
According to the revised Rules of Procedure, Council must
review the objections filed and forward a copy of their position, in
respect of the objections, to the Municipal Board. It is not necessary
to forward reasons in support of Council's position.

The objections raised, are in respect of the entrance
location, and its proximity to a public park and hotel, and storm
drainage of the site.
COMMENTS:
At the discretion of Council, By-law 79-82 may be re-
pealed and/or repealed and revised in an attempt to accommodate the
expressed concerns. Alternatively, Council may advise the Municipal
Board that it wishes to proceed with By-law 79-82.
Staff note that the concerns about storm water drainage
contained in the submitted objections, were considered in our review
of the subject application and will be addressed through the terms
of the required development agreement(s). We also note that no com-
ments or objections were received, through our circulation, relative
to the physical location of the proposed site access. This too, would
be a matter dealt with through the development agreement(s).
Based on the foregoing, we cannot support repeal or re-
vision of By-law 79-82.
RECOMMENDATION:
That the Planning and Development Committee recommend to
Council the following:
1. That this report be received; and that
2. The Ontario Municipal Board be advised that the Council
for the Town of Newcastle has reviewed the objections re-
ceived to By-law 79-82Aand that Council wishes to proceed
with By-law 79-82 as approved by Council on August 27, 1979.
