RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-111-03 be received;
2. THAT Council declare the property identified as Block 30, Plan 10M-775, 97 Potters
Lane, Enniskillen, as surplus and offered for sale.

1.0 BACKGROUND
By-law 95-022, being a by-law to establish procedures governing the sale of real
property pursuant to the Municipal Act, was approved by Council on March 6, 1995.
The procedures state that from time to time the Municipality may:
. Identify real property that should be declared surplus by Council
. Report to Council recommending that Council declare the particular real property
to be surplus property and setting out the reason why it should be declared to be
surplus property, and
. Advise that at least one appraisal of the fair market value of the real property
should be obtained before Council decides to sell or exchange or transfer the
real property, unless an appraisal is not required under the Act
2.0 COMMENTS
The property is located at the southeast corner of Regional Road 3 and Potters Lane in
Enniskillen (Attachment 1). It is an irregular shaped lot with 61.9 metres (205 ft) of
frontage on Potters Lane and a lot area of approximately 0.6 hectares (1.48 ac). There
is a one foot reserve along the Regional Road 3 frontage limiting access to the lot from
Potters Lane (Attachment 2). The site was acquired as a condition of approval of plan
of subdivision 10M-775. It is zoned Residential Hamlet (RH) which would permit the
construction of one single detached dwelling unit subject to all building permit
requirements being met. The Block is situated in a low lying area containing mostly
bulrushes and other similar vegetation. The Director of Operations has confirmed that
the lot is not being maintained by the Municipality.
The Engineering Services Department have indicated that there are no existing
parkettes or any other park facilities owned by the Municipality in Enniskillen. The only
recreational facilities are located at Enniskillen Public School which contains a
playground, basketball court, baseball diamonds and play fields. Engineering have not
had any requests from the hamlet residents to provide additional facilities. The lot has
been in the Municipality's ownership for 16 years. Since the topography of the site and
its limited size make it undesirable for parkland, Engineering Services support declaring
the Block as surplus property.
Any properties declared surplus are to be advertised for public tender in accordance
with By-law 95-022. Should Council deem it appropriate to declare Block 30, Plan 10M-
775 as surplus it will be advertised in conjunction with other municipal properties which
have previously been declared surplus but which have not been sold to date. A
property appraisal has been completed by Property Valuators/Consulting Inc. and as of
September 11, 2003, the fair market value is estimated to be $77,500.00.

3.0 CONCLUSION
In accordance with By-law 95-022, the Director of Engineering has reviewed the
proposed declaration of Block 30 as a surplus property and has no objection. The
proceeds from the sale of this lot will be utilized to fund other lands which are required
for public use.
