SUBJECT: Official Plan Amendment Application 79-6/D
Part of Lot 35, Concession 3, former Township
of Darlington (Mr. G. Gabourie)
BACKGROUND:
On July 16, 1979, Town Council passed resolution #C858-79,
as follows:
"That with regard to Item I (Planning and Development Com-
mittee Chairman's Report) it be resolved that O.P.A. 79-6/D
(Gabourie) be approved and the recommendation of the Com-
mittee in this regard not approved."
The Council resolution refers to the Planning and Develop-
ment Committee's resolution of June 11, 1979 as follows:
"That Report P-83-79 be endorsed and the Region of
Durham be advised that the Town will consider Official
Plan Amendment application 79-6/D further at such time
as the Regional Official Plan has been approved as it
applies to the Courtice Urban Area."

At the August 23, 1979 Planning and Development Committee
meeting, Dr. Michael outlined his concerns in respect of Town
Council's position on the Gabourie application. Dr. Michael out-
lined the implications of approving the Gabourie application outside
of the Courtice Urban Envelope and as an isolated residential desig-
nation within an approved major open space designation. It was
suggested that Council reconsider its position on the Gabourie appli-
cation and consider the redesignation of the entire area between Nash
Road, the Courtice Urban Area boundary, Adelaide Avenue (extended)
and Townline Road for residential and associated land uses. It was
also noted that under the existing Major Open Space System designation
in the Regional Official Plan limited non-farm residential dwellings
may be allowed in the form of infilling. (Section 10.2.1.3)
COMMENT:
Staff have considered Mr. Gabourie's request in the light
of the comments made by Dr. Michael and with reference to earlier
comments received from other agencies.
It is noted that the Regional Works Department has recently
reviewed the potential servicing of the subject area and has indicated
that any development on the subject land has to proceed on the basis
of partial servicing (i.e. municipal water supply and private sanitary
disposal). Regional Works note that sanitary sewers will not be avail-
able as the subject lands are not within the Courtice Urban Area.
Currently the subject lands are designated as "Major Open Space
and Hazard Lands" within the Durham Regional Official Plan which would
allow for limited non-farm residential development in the form of in-
filling.

Infilling refers to situations where one or more non-farm residential
dwelling are to be located on the same side of a public road and
within a distinct node or cluster of non-farm residential dwellings.
The policy contained within the Regional Official Plan is to be
further defined through the implementing by-laws.
It is the feeling of staff that the redesignation of the
subject lands would be premature at this time pending adoption of
the Courtice Urban Area Plan, the completion of the Courtice Storm
Water Management Study and the determination of future sewage capacity
in the Courtice Area. Staff note that the current designations do
not preclude development in the subject area and that as development
proceeds within the Courtice Envelope that it may be appropriate to
amend the Regional Official Plan to include the subject area as a
portion of the Courtice Envelope.
RECOMMENDATION:
That the Planning and Development Committee recommend to Council
that the Region of Durham be advised that:
1. The Town of Newcastle considers the redesignation of the
Gabourie property, Part of Lot 35, Concession 3, former Town-
ship of Darlington, Official Plan Amendment application 79-6/D
as premature, and further,
2. That the Town feels that it would be appropriate for file
79-6/1) to be held open pending future consideration of the
subject proposal.
