REPORT NO.: P-195-79 SUBJECT: Ontario Municipal Board Hearing re; By-law 78-117 (William Henderson) - Part of Lot 18, Concession 7, former Township of Darlington - Our File No. Z -A-1-15-7 RACKpRn wn By-law 78-117 rezoned a 1.548 acre parcel of land in the south east quadrant of Enniskillen from Deferred Development to Cl -2 to permit the continuation of the existing single family dwelling and butcher shop on the site. The By-law was advertised and circulated to property owners within 400 feet of the subject site, according to the requirements of the Ontario Municipal Board Rules of Procedure. Two letters of objection to the By-law were filed within the 21 day period allotted for objections. These objections will be considered at an Ontario Municipal Board Hearing scheduled for December 10, 1979. COMMENTS: ; It is the opinion of staff that the ultimate disposition of this matter will not affect the interests of the Town. For this reason, we can see no need for either staff or the Town Solicitor to be represented at the Hearing. - 2 - RECOMMENDATION: It is respectfully recommended: 1. That the contents of this report be received for information, and 2.J That the applicant and the Ontario Municipal Board t// be advised that the Town of Newcastle will not be represented at the Ontario Municipal Board Hearing in respect of By-law 78-117.
