BACKGROUND:
Report Number P-162-79 recommended approval of a request,
submitted by the Region of Durham Works Department, requesting the
rezoning of lands owned by the Region east of the proposed site of
the Soper Creek Water Pollution Control Plant to prohibit residential
uses adjacent to the plant.
This report was considered by the Planning and Development
Committee on September 17, 1979, and the recommendations contained in
the report were endorsed, by resolution PD -426-79, "subject to input
from a public meeting to be held at the next Planning and Development
Committee Meeting".
The requisite public meeting was held on October 1, 1979, and
several area residents appeared in opposition to the proposed rezoning,
on the grounds that it would facilitate the development of the Soper
Creek Water Pollution Control Plant.

Shortly after the October 1, 1979 meeting reconvened on
October 5, 1979, staff was advised by telephone by a representative
of the Region of Durham Works Department that the Region wished to
withdraw the subject application for rezoning. This information was
relayed to the members of the Committee, and the following resolution
was made:
"Resolution PD -454-79
That Report P-162-79, Rezoning Application Z-0-13-1
Soper Creek Water Pollution Control Plant, be tabled
until written confirmation is received from the Region
of Durham that they are withdrawing the application."
On October 10, 1979, the attached letter, requesting with-
drawal of the subject application, was received from the Region of
Durham Works Department.
RECOMMENDATION:
It is respectfully recommended:
1. That Report P-162-79 be lifted from the table; and
2. That Report P-162-79 be received for information.

Re: Port Darlington Water Pollution Control Plant -
Parts 1 & 2, Plan 1OR-946
Further to our discussions of October 5, 1979 and our
previous correspondence of July 17, 1979 (copy enclosed),
we wish to advise you as follows.
The above noted lands, being Parts 1 and 2, Plan 1OR-946
were purchased by the Region in order to complete the
necessary Buffer Zone between the Port Darlington Water
Pollution Control Plant Site and surrounding land uses,
which was a requirement of the Ministry of the Environment.
Upon further examination by the Regional Works Department,
the existing zoning (M-1 Light Industrial), on the subject
lands, which precludes residential uses, would be satisfactory
in order to satisfy the requirements of the Ministry.

SUBJECT: Soper Creek Water Pollution Control Plant
(Our file Z-0-13-1)
The attached By-law 78•-74 amended the Bowmanville Zoning By-law
by changing the zone designation of the site selected for the Soper
Creek Water Pollution Control Plant from M-1 to M-2 SPECIAL PROVISION
8 to permit the construction of the proposed plant. This By-law
was approved by the Ontario Municipal Board on October 10, 1978.
Subsequently, the Ministry of the Environment advised the
Region of Durham that, in order to minimize the conflict between
incompatible land uses, a buffer was required between the plant
and adjacent residential uses, To this. end, the Ministry required
the Region to aquire additional lands to the east of the proposed
plant, and to insure that the lands, be zoned to preclude residential
uses. In turn, the Region has requested the Town to amend the
Bowmanville Zoning By-law to facilitate the provision of this
buffer zone.

COMMENT:
The site proposed for rezoning is presently zoned M-1, and only
a single family dwelling occupied by an owner or caretaker of an
industrial use on the lot is permitted. We have no objection to
restricting the use of the lot to non-residential uses.
However, in light of the concerns of the Ministry of the
Environment, we respectfully submit that it would be preferable
to retain the M-1 zoning of the lands, instead of zoning the buffer
lands to permit a sewage treatment plant and related facilities,
as was suggested by the Region.
RECOMMENDATION:
It is respectfully recommended:
I. THAT the Region of Durham Works Department be advised that the
Town agrees with the preclusion of Residential uses from the subject
lands, but that an industrial zoning would be more appropriate; and
2. THAT the attached By-law 79- be .forwarded to Council for
approval and to the Region of Durham .for information.

THE CORPORATION OF THE
TOWN OF NEWCASTLE
BY-LAW NUMBER 79 -
being a By-law to amend Restircted Area By-law Number
1587, as amended, of the former Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restircted Area By-law Number 1587, as amended,
of the former Town of Bowmanville.
NOW THEREFORE the.Cotmcil of the Corporation of the Town of Newcastle
ENACTS as follows:
1. Schedule "B" to By-law 1587, as amended, in hereby further
amended by adding thereto the following:
"SPECIAL PROVISION 10,
Parts 1 and 2 according to a Reference Plan registered in
the Registry Office for the Registry'Division of Durham (No.10)
as Number IOR-946, shall be subject to the special regulations
hereinafter contained and where there is any conflict between
the regulations hereinafter set out and any other provisions,
of this By-law, then the provisions of these special regulations
shall apply, but in all other respects the provisions of this
By-law, as amended shall apply.
1.1 Defined Area
The area subject to this, special condition is, the
whole of pafts 1 and 2, Plan 1OR-946.

1.2 Permitted Uses
All uses permitted by Section 19 of this By-law, except
that, notwithstanding the provisions of Section 19 (b) of
cl,is By-law to the contrary, no person shall use any
building or structure, or part thereof, for any residential
purpose."
2. Map 6 of Schedule "A" to By-law 1587, as amended, is hereby
further amended by applying SPECIAL PROVISION 10 to the zone
designation of the whole of Parts 1 and 2, Plan 1OR-946.
3. This By-law shall come into effect on the date hereof, subject
to the provisions of Sectopm 35 (10) of the Planning Act.
