(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF October 15, 1979. REPORT NO.: P-180-79 SUBJECT: Application for Rezoning Number Z -A-3-6-5 . Part Lot 32, Concession 7, former Township of Clarke Dennis and Vella Prue BACKGROUND: The subject application requests an amendment to the Clarke Zoning By-law to change the zone designation of a parcel of land on the west side of Leskard Road in the Hamlet of Leskard from "Agricultural" to "Rural Residential". The site is designated "Hamlet" in the Region of Durham Official Plan. We have been advised by the Region of Durham that the proposed By-law would permit limited residential development in the form of in- filling, and, therefore, would implement the policies of the Regional Official Plan. The site is presently zoned "Agriculture" in the Clarke Zoning By-law. The proposed by-law would change the zoning on the property to "Rural Residential", to allow the applicant to erect a single family dwelling. - 2 - The application was circulated to the Northumberland and New- castle Board of Education, Peterborough -Victoria -Northumberland and Newcastle Separate School Board, Durham Planning Department, Durham Health Unit, Bell Canada, Ganaraska Conservation Authority, Ontario Hydro, Newcastle Works and Building Departments. None of these agencies objected to the proposed By-law. The Durham Planning Department stated that: "The subject site is located in Leskard, a designated "Hamlet" in the Durham Regional Official Plan. Residential develop- ment in Leskard is limited to minor internal infilling and minor additions to existing development. Proposed by-law would implement the Durham Regional Official Plan policies. In addition, we note that hazard lands are indicated on the site. In this regard, the appropriate conservation authority should be consulted in order to ascertain the suitability of the site for the residential use. With respect to the provision of regional services, sanitary sewer and water supply facilities are not available to the subject land and the Region has no plans to extend these ser- vices to this area of the Town of Newcastle. All requirements, financial and otherwise, of the Region will be covered under specific conditions which will be recommended as conditions of approval for the related land division application." The Ganaraska Conservation Authority stated that: "A portion of the subject property falls within the flood plain of the small creek which passes through the west section of the property. It is our recommendation that the flood plain be appropriately zoned to signify the potential hazard and environmental fragility of the area (i.e. open space/environ- mental protection)." COMMENT: A previous application for amendment to the Clarke Zoning By-law was submitted on November 12, 1974, by Mr. Dennis Thompson. The reason for submitting this application was as a result of Mr. Thompson construct- ing a single family dwelling within the flood plain of the creek to the - 3 - west of the property and prior to the issuance of a building permit. The application had requested the same zone classification as the application submitted by Mrs. Prue. The By-law affecting Mr. Thompson's property was By-law 75-98, which had received two readings by Council, but had never received the final reading. Mr. Thompson then appealed this decision to the Ontario Municipal Board, however, his case was dismissed. Mrs. Prue has since purchased the property and wishes to have it f rezoned. Since the proposed By-law would implement the policies of the Region of Durham Official Plan, and would result in a continuation of the Rural Residential zoning, we have no objection to the subject appli- cation for rezoning. RECOMMENDATION: It is respectfully recommended: I. That application Z -A-3-6-5 be approved; 2. That the attached By-law Number 79- be forwarded to Council for approval.
