(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF October 1, 1979. REPORT NO.: P-173-79 SUBJECT: Rezoning Application Z -A-2-6-3 - Lot 10, Concession 2, Bowmanville - A. Brooking R A PYnP nTTMn - On July 5, 1979, the Planning and Development Committee con- sidered the above mentioned application and moved to convene a Public Meeting on July 23, 1979. At the Meeting of July 23rd, Committee re- commended to Council that the rezoning be approved subject to the fol- lowing conditions: 1. That the applicant enter into a Development Agreement as described in Section 35 (a) of the Planning Act with the Corporation of the Town of Newcastle, and 2. That the said Development Agreement be signed by the applicant and the Town of Newcastle prior to approval of the By-law, 3. That the south half of the subject property, or the or the minimum area in the southern portion only, be rezoned to the appropriate designation to permit a special condition for commercial or industrial designation. G �I (Chairman's Report Item 11) 2' 1 K' - 2 - On July 30th, 1979 the subject application was considered by Town Council and the following resolution passed: "That Item 11 be tabled to allow Mr. Ewert to submit a further report to the first Planning and Develop- ment Committee Meeting in September." On September 18, 1979, the Planning Department received a copy of a brief from Mr. C. Ewert in support of the Brooking Rezoning application. Staff have reviewed the brief and discussed same with the Town's solicitor and are satisfied that the existing uses of the subject property are legal non -conforming under the current zoning. In view of the Committee's previous position on the rezoning application, it would be appropriate for the Committee to instruct staff to bring forward the necessary rezoning by-law for future con- sideration by Committee and Council.
