SUBJECT: Ontario Municipal Board Hearing of Objections against
By-law 79-7, Paul Papanikolopoulos

BACKGROUND:
By-law 79-7 amends the Darlington Zoning By-law by changing the
zone designation of part of Lot22, Concession 2, Darlington from "Agri-
culture" to "C2-4" to permit the development of a convenience retail
store and a take-out restaurant on the site. This By-law was approved
by Council on January 29, 1979 and circulated to abutting landowners
in accordance with Ontario Municipal Board regulations. Three letters
of objection were received by the Clerk within the twenty-one day period
allotted for objections. These objections will be considered at an
Ontario Municipal Board Hearing, schedule for September 4, 1979.
COMMENTS:
The residents who have objected to the By-law seem to be concerned
about site design matters rather than about the suitability of the site
for the use proposed (see attached letters). The proposed By-law requires

the negotiation of a development agreement before building permits
are available to the site. The applicant is in the process of having
a detailed site plan prepared, which will serve as a basis for the
negotiation of the agreement. It is hoped that this site plan will
be completed, so that the objectors and the Municipal Board can evaluate
whether the concerns of the residents can be resolved through site design.
The applicant, accompanied by his solicitor, will be present
at the Hearing in support of By-law 79-7. Under the circumstances, we
do not feel that it is necessary for the Town of Newcastle to be repre-
sented at the Hearing.
RECOMMENDATION:
It is respectfully recommended:
1. That the contents of this report be received for
information, and
2. That the applicant be advised that the Town of Newcastle
will not be represented at the Ontario Municipal Board
Hearing in respect of By-law 79-7.
