SUBJECT: Application for Rezoning Number Z-A-3-11-3
Block 48, Hanning's Plan, Village of Newcastle

BACKGROUND:
On February 28, 1979, an application was submitted requesting
an amendment to the Village of Newcastle Zoning By-law to permit the
development of a 1.2 acre parcel of land situated in Block 48, Hanning's
Plan for the Village of Newcastle. The applicant proposes one residential
lot on this site.
The subject site is designated as "Permanent Agricultural Reserve
Area" in the Durham Official Plan. Section 11.2.5 of the Plan states
"non-farm residences and other uses not related to agriculture shall not
be permitted within this designation." Therefore, the proposed rezoning
does not conform with the provisions of this designation.

The site is zoned "Rural Zone" and "Rural Residential" in the
Village of Newcastle Zoning By-law. Residential uses are permitted under
these zoning categories.

COMMENT:
The application was circulated to the following agencies for
comments:
1. Northumberland & Newcastle Board of Education
2. Peterborough-Victoria-Northumberland & Newcastle
Separate School Board
3. Durham Planning Department
4. Durham Works Department
5. Durham Health Unit
6. Bell Canada
7. Newcastle Village Public Utilities Commission
8. Newcastle Works Department
9. Newcastle Building Department
10. Newcastle Fire Department
Bell Canada, Northumberland and Newcastle Board of Education,
Newcastle Public Utilities Commission, the Chief Building Official,
the Peterborough-Victoria-Northumberland and Newcastle Separate School
Board, and the Durham Health Unit advised that they had no objections
to the proposed rezoning. Other comments are summarized below:
1. The Durham Planning Department and Works Department advised
as follows:
"We have reviewed the above-referenced application and wish
to provide the following comments:
The Durham Regional Official Plan designates the subject
site as "Permanent Agricultural Reserve". Non-farm residen-
tial uses are not permitted in this designation. The pro-
posal, therefore, does not conform to the Durham Plan.

Regarding the provision of Regional services to this
site, notwithstanding the Durham Regional Official Plan
designation, there is an existing watermain on Mill
Street which could service two of the proposed. However,
a watermain would have to be extended from Mill Street
to service the proposed lot on Metcalf Street. We note,
as well, that sanitary sewers are not available to the
subject lands. Since the subject lands are located out-
side of the urban area boundary of the Village of Newcastle,
the Region would, therefore, not extend sanitary sewers
or watermains to provide municipal services to this site.
In summary, we cannot comment favourably on this appli-
cation due to non-conformity with the Durham Regional
Official Plan."
( 2. The Newcastle Fire Department submitted the following
list of requirements;
"1) Access for fire emergency vehicles from the travelled
portion of an approved road or driveway,
2) Fire hydrants to be located within 350 feet of build-
ings to be protected,
3) Building materials and design in accordance with fire
safety regulations."
3. The Newcastle Works Department submitted the following
comments:
"1) The plan for the subject application shows Mill Street
as being 62.70 feet in width. If this is correct,
additional land would be required in order to provide
a 66 foot right-of-way.
2) Access to the proposed three lots would be by way of
Mill Street and Metcalf Street."
CONCLUSION:
Since the site is designated "Permanent Agricultural Reserve"
in the Durham Official Plan and residential uses are not permitted under
this designation, it would appear the applicant would require an Official
Plan Amendment prior to the approval of this rezoning application.

RECOMMENDATION:
It is, therefore, recommended:
1. That application for rezoning number Z-A-3-11-3 be tabled,
pending approval or denial of an Official Plan Amendment, and
2. That the applicant be advised to submit an application to
amend the Region of Durham Official Plan.
