REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF July 23, 1979.

SUBJECT: Official Plan Amendment Applications
File: 75-29/D - Brooks, Lovell & McLellan
77-13/D - Edward Whiting
77-30/NB - Wilswar Enterprises Ltd.
BACKGROUND:
On July 10, 1979, the Town received the attached letter
from the Durham Regional Planning Department. The applications subject
of that letter have all been previously dealt with by Town Council. In
that regard, the actual status of each was dependent upon certain pend-
ing actions.
The Brooks, Lovell & McLellan application required action
by C.L.O.C.A. while the other two were to be resolved by further studies
to be completed by the Town.
It is the Region's position that these files should be closed

and the applications denied subject to their further review during sub-
sequent actions on the Town's part; rather than being held in abeyance.
Staff have reviewed the request, and while Council's position on these
applications is quite clear, we have no objection to the Region's pro-

posal.

RECOMMENDATION:
That the Planning and Development Committee recommend
to Council the following:
1. That this report be received; and that
2. The Region of Durham be advised that the Town
has no objection to their proposed method of
dealing with the subject files.

This Department is in receipt of your Council ' s
recommendation which has placed the above-noted
official plan amendment applications in a pending

state.
Notwithstanding the fact that often complex planning
issues are involved in the evaluation and processing of
official plan amendment applications , it remains the j
intention of Regional Council to expedite the processing
of such applications subject to more detailed secondary
planning, special studies , Ontario Municipal Board
hearings, etc . should not be maintained in a "pending"
state; but rather, a more desirable course of action
would be such that the applications be denied, with the
assurance that the applicant ' s concerns are taken into
account in those subsequent actions which overshadow any
prior decision-making on a particular proposal .

In this respect, we will be recommending to the region ' s
Planning Committee that the above-noted applications be denied;
and that the respective proposals be considered in conjunction
with the implementation of the related Secondary Plans and/or
studies. If you have any difficulty with this proposed
procedure, please notify this Department within 2 weeks of the
date of this letter.
If you have any inquiries regarding this matter, please do not
hesitate to contact this Department.
