REPORT NO. : P-131-79 SUBJECT: Application for Rezoning Number Z-A-2-6-3, Part Lot 10, Concession 2, former Town of Bowmanville - Brooking Transport 3ACKGROUND: On July 16, 1979, Council adopted the following recommen- dation of the Planning and Development Committee: "That a public meeting be held on July 23, 1979 to receive convents with regard to Application for Rezoning, Part Lot 10, Concession 2, Bowmanville, Brooking, and it be the first item on the agenda and a draft By-law be prepared." COWNT: According to this directive, staff has prepared the attached draft By-law for consideration by the Committee. However, because of the potential incompatibility of the existing commercial use with existing and proposed residential Development in the area, it is strongly suggested that if the Committee wishes to approve the subject application, a Site Plan Agreement be- tween the applicant and the Town should be required as a condition of' approval of the subject 'yt - 2 RECOMMENDATION: It is respectfully recommended that any approval of By-law 79-- be subject to the following conditions: 1,. That the ,:applicant enter into a Development Agree- ment, as described in Section 35(a) of the Planning Act, with the Corporation of the 'Town of Newcastle, and I 2.
