(416) 2631231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF July 23, 1979, REPORT NO. :: P-127-79 SUBJECT: Proposed Amendment No. 3 to the Durham Regional Official Plan — File No. : 78-21/1) BACKGROUND., The area subject of the above noted amendment are those lands presently designated as Special Study Area 12 by the Durham Regional OEficial Plan. This area is ;:more commonly referred to as the Port: Granby Waste Management Facility operated by Eldorado Nuclear Ltd., At one time, the site was considered as a possible location for a uranium refinery and long term waste management facility which resulted in its designation as a special study area. This proposal was subject Co review by the Federal Environmental Assessment Panel which concluded that Special Study Area 12 was not acceptable for the proposed facility. Ile Minister of Environment Canada subsequently concurred with the Panel"s recommendation, therefore, ruling out the location of such a facility on the subject lands . With respect to the waste management facility presently being operated on the site, the Town was requested, in September 1978, to comment 1 capon a proposal to extend Eldorado's licence for a one year period„ In October of that year, the Planning Committee recommended that the Atomic Energy Control Board be requested to have Eldorado prepare plans for the decommissioning of Port Granby, excluding its use for i long term waste management:.; and giving support to Hope Township's i request to have the refinery located there. In December of last year, a delegation from Eldorado appeared before the Committee with respect to the extension of the Port Granby Licence. At that Mime., the Committee recommended that the A.E.C.B, be advised that the Town had no objection to the rullcerising conditional upon receiving a report from Eldorado outlining plans for decou ni.ss:ioning. This resolution was gabled in order to have Town staff prepare a report on the subject, it is our understanding that this report is to be prepares( by the Town Mager. The maU_ur wns> referred to Chu "hydro Committee" on July _i, 1979, thus removing; it from the Planning Committee's :List: of outstandky business. On July 5, of this year, the 'Town received a letter from the Region of Durham requesting comments with respect to Regional Official Plan 78-21/1). That request indicated that notwithstanding the Town's position I in respect of the Atomic Energy Control Board's request for comments, Wat body had granted thu extension of Edo.rado's licence for +a period of one year. Furthermore, the AN.C.B, had indicated its recognition i of the fact that the subject site was unsuitable for long term waste i management. The A.E. C.B. is presently reviewing Eldorado's proposals for the decommi ss Toning and remova L of all wasters in order- to :render the area safe for other, uses. Based upon our review of previous Committee resolutions and the information provided by Eldorado respecting these r 3 ._. resolutions , it would appear that the A.E.C.B. , in reaching their decision, have acknowledged the Town's concerns whale recognizing the time constraints involved. In that regard, the necessity for a report from the Town Manager or a Coun.c:i.l resolution respecting Eldorado's licensing may have been eliminated . However, based an I the fact that the subject site will event:ually be decommissioned, i the Special Study Area designation can now be lifted and alternative land use designations determined. COMMENTS: Staff have reviewed proposed. Amendment_ No. 3 to the Durham Regional Official Plan and are ss:t:i_sfied with the intent of same; which proposes agricultural and major open space designations for this site. Naturally the ultimate use of these lands for said purposes will depend upon the success and timing of plans to decommission the site to n state wherein it would be sale for these uses, in that regard, it may be appropriate to include a provision Within the proposed amendment to the effect that consideration shall_ only be given to permitting these use> upon conf.ir rna.tion from the A.,F..C.B. that the site has been successfully made safe . Alternatively, the Special Study .Area designation should remain in effect until such time as the site is actually safe for these uses. I RECOMMENDATION: That the Planning and Development Committee recommend to Council the following: 1. That this reporr be received; and that I I I 4 _. 2. The Region of Durham be advised that the Town of Newcastle has no objection to proposed Amendment No, 3 to the Durham i Regional Official Plan affecting the Eldorado Waste h[anage- ment site at Port Granby, provided that the subject site is returned to a safe state permitting the proposed agricultural and major open spice uses without danger to health or property of potential users.
