(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF July 5, 1979. REPORT NO. : P-113-79 SUBJECT: Application for Rezoning Number Z-A-1-11-9 - Proposed Re-designation of Road Allowance between Lots 2 and 3, Concession 5, Darlington - S. Vasvik BACKGROUND: An application has been submitted requesting an amendment to the Darlington Zoning By-law to change the designation of the road allowance between Lots 2 and 3, Concession 5, Darlington from Class "B" Public Street to Class "A" Public Street. The proposed rezoning would permit the erection of buildings and structures on lots fronting on the subject road allowance, provided that all other requirements of the By-law can be met. We have been advised by the Town of Newcastle Works Department that the subject road allowance was physically improved in May 1979. However, the Darlington Zoning By-law has not been amended to recognize these im- provements and, therefore, the road has retained its designation as a Class "B" Public Street. Since Section 4(f) of the Darlington By-law prohibits the erection of any building or structure on lots abutting a Class "B" Public Street, building permits have not been available for these lots. - 2 - The proposed redesignation was considered by the Town of Newcastle Works Committee at its meeting of February 16, 1978, and the following recommendation was submitted to Council, and subsequently adopted: "That we concur with the request of Mr. and Mrs. Vasvik conditional upon this meeting with the Town's Policy." COMMENTS: As the road allowance has already been physically upgraded, and because the proposed redesignation has been considered by the Town of Newcastle Works Committee, we have no objections to the pro- posed amendment to the Darlington Zoning By-law. A proposed zoning amendment is attached. RECOMMENDATION: That the Planning and Development Committee recommend to Council that By-law 2111 of the Township of Darlington be amended and that the attached By-law be approved. Respectfully submitted, if EP:lb D. N. Smith, M.C.I.P. June 27, 1979 Director of Planning M E M O R A N D U M TO: G. Gray, Deputy Clerk FROM: Norma Forrest, Current Operations Planner DATE: June 29, 1979. SUBJECT: By-law 79- ' q (Sig Vasvik) 1. Purpose and Effect The purpose and effect of By-law 79- is to change to Class 'A' Public Street the zone designation of the road allowance between Lots 2 and 3, Concession 5, Darlington, as shown on the attached Schedule "X". This would permit the erection of buildings and structures on lots fronting on the subject road allowance. 2. Conformity with Official Plan The Durham Regional Official Plan and the Official Plan for the former Township of Darlington do not address themselves to the classification of local roads. Therefore, the proposal would not have an effect on the policies of the Official Plan.
