REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING of June 11, 1979.
REPORT NO. : P-98-79
SUBJECT: Referral to the Ontario Municipal Board of a portion of the
Durham Regional Official Plan - R-51 - T. Tomina
BACKGROUND:
At the Council Meeting of May 23, 1979 the following resolution
was passed in respect of the Town's position on R-51.
"THAT the Director of Planning be requested to check with
Mr. Tomina and appropriate staff person at the Regional
Planning level regarding Regional Official Plan amend-
ment referral R-51 with the intent of resolving Mr. Tomina's
problem to all parties satisfaction."
The following Resolution #C-653-79 was also passed:-
"THAT Item No. A of the Town Clerk's Report i.e. that
recommends that Resolution #C-527-79 be rescinded be
approved and Item #B be tabled until the next meeting.
Item #B reads as follows:
'THAT Item No. 7 of the Planning Advisory Report to
Council on June 7th, 1977 be rescinded. '
The said Item 7 reads as follows:-
'Subdivision Approval Application #S-A-1-5-1
Mark Tomina, Part Lot 26, Concession 2, Darlington
That this application be approved subject to the
following conditions:
1) A 10 foot road widening be provided on Nash Road `,
and Hancock Road. 1

2) The Area of lot 2 be increased to conform with
the proposed R-1 Zoning.
3) The area below elevation 454.5 feet be excluded
from the plan. "'
On June 1, 1979, Staff met with Mr. Tomina and his representatives
and Dr. Michael, Commissioner of Regional Planning and Development.
At that meeting, several possible approaches to the development of
Mr. Tomina's land were discussed.
Alternative 1
Mr. Tomina may proceed with his objection to the proposed
"Open Space" designation on his lands and make representation
before the Ontario Municipal Board. The Town of Newcastle
may submit a position to the Municipal Board in support of
the Region's designation in favour of Mr. Tomina's request.
Alternative 2
Mr. Tomina may withdraw his objection to the Regional Offical
Plan and request the Town to rezone his lands as part of
a "node" or "cluster" as permitted by the Regional Official
Plan. Upon rezoning by the Town, Mr. Tomina could proceed with
his subdivision application or make separate severance applications.
This alternative has apparently been discussed in past meetings
with the Region. It was noted that Mr. Tomina's site did not form part
of a "cluster" as contemplated within the Regional Official Plan. It
was also noted that any rezoning proposal to designate a cluster in this
area would form a precedent and, therefore, should only be done in the
context of other potential "clusters" in the Town of Newcastle.

Alternative 3
Mr. Tomina may withdraw his objection to the Durham Regional
Official Plan and proceed with an Official Plan Amendment
application. The Official Plan Amendment application may
request an exemption from the provisions of the "Open Space"
designation in the Regional Official Plan.
The Town of Newcastle may support the Official Plan Amend-
ment application and comment to the Region to that effect.
RECOMMENDATION:
That the Planning and Development Committee consider the
alternatives outlined in this report and recommend to Council that
one of the three alternatives be endorsed.
