(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF June 11, 1979 REPORT NO. : P-88-79 SUBJECT: Attached Letter from Davis, Webb, Barristers and Solicitors Re: Courtice Urban Area Plan BACKGROUND: The above mentioned letter was received prior to the Public Meeting of April 25, 1979 held in respect of the Courtice Urban Area Plan. COMMENT: The letter raises a number of concerns in respect of portions of the draft Courtice Urban Area Plan, related to Open Space and Recreation, Hazard Lands and the proposed transportation network. Direct reference is made to the Prestonvale Road. It is the intention of staff to address the concerns raised in the attached letter in the course of evaluationg the draft Urban Area Plan for Courtice. Staff note that discussions have been held as to possible modifications to the alignment of Prestonvale Road. Further discussions are to take place in that respect upon receipt of all comments in respect of the Urban Area Plan. It appears at this time, that some - 2 - changes to the alignment of Prestonvale Road may be possible and are desirable. RECOMNENDATION• That the Planning and Development Committee recommend to Council that: 1. Dear Sir, Re: Draft Courtice Urban Area Plan I act on behalf of Courtice Heights Developments, the owner of five parcels of land in the Courtice area of the Town of Newcastle. ! have had an opportunity to review the above mentioned draft -plan and provide the following comments for your consideration. 1. Open Space and Recreation policy 2.3 . 2 . (e) states that hazard lands or environmentally sensitive lands shall not be acceptable as part of the dedication for park purposes under Section 33 of The Planning Act. This provision is considered unduly restrictive and should reflect the more permissive spirit of Section 1.2 . 9 of the Regional Official Plan which employs the expression "such Hazard Lands at the discretion of the Council of the respective area municipality may not form part of the dedication for park purposes" . 2 . The hazard land designation in the area occupied by subdivision 18T-76048 does not reflect what has already been engineered and agreed to by the authorities having jurisdiction. The draft plan for the Courtice Urban Area should be revised accordingly. The hazard land designation shown crossing a 13 acre parcel in Lot 30 , Concession 3 , at the north-east corner of Trull ' s Road and Nash Road appears to 'be excessive aftd should be redefined to reflect the minor hazard associated with this small watercourse. The hazard land designation shown on the 40 acre parcel situated in Lot 27 , Concession 3 , appears to be in error. A site inspection does not indicate any hazard associated with this parcel. The draft Courtice Area Urban Plan should be amended to delete this designation from this parcel . A map showing the affected areas is attached for your reference . Continued. . . . DAVIS. /EBB & HOLLINRAKE Page 2 . 3. The proposed transportation network is shown on Schedule 1 of the draft plan and also in Appendix E. A new collector road is proposed west of Prestonvale Road for reasons not detailed in the planning document. While such a new road may be required in the fullness of time to service traffic' needs when Courtice is fully urbanized, the immediate need of improving existing Prestonvale Road should be recognized. With reference to the traffic impact of subdivisions 18T76027 and 18T76048 , the Town of Newcastle commissioned a report which was prepared by the I.B.I.Group in August 1977 and tendered as evidence during the course of the O.M.B. hearing on these two plans of subdivision. Conclusion 4 of that report is relevant and refers to the Town' s Road Needs Study which identified Prestonvale Road as being "structurally deficient and in the now needs for complete reconstruction." The I.B. I. Group concurred with this conclusion in the Road Needs Study and emphasized that Prestonvale Road would require reconstruction to accomodate projected traffic generated from the proposed development.. The Town of Newcastle has recognized the immediate need to reconstruct Prestonvale Road by signing a subdivision agreement which outlines the cost sharing arrangement between the Town and the developer for the improvement of Prestonvale Road to urban standards. From the foregoing, it is apparent that existing Prestonvale Road will have a collector function in the immediate future. This collector function of existing Prestonvale Road between Claret Road and Highway 2 should be recognized in the draft plan for the Courtice Urban Area. The longer term future nature of the new collector road is evident because its alignment is dependent on the resolution of planning issues in Stage 2 (a) of the Staging Plan shown in Appendix G. The collector road shown in Neighbourhood 3b on the lands occupied by subdivision 18T76027 does not conform with the pattern of Sandringham Drive approved by the Ontario Municipal Board. This road alignment should be corrected on the draft Courtice Urban Area Plan. The collector road pattern shown through subdivision 18T76048 does not appear to reflect the road system approved by the Ontario Municipal Board. The draft plan for the Courtice Urban Area should be corrected accordingly_ Although Phair Avenue (a local street) is shown as intersecting Prestonvale Road, Claret Road (a new local street) has been mistakenly omitted from the draft Courtice Urban Area Plan. This new local road should be included for consistency. 5 . Residential development policy 2 .1. 3 (i) states that any proposal for development shall require a detailed field investigation of the-environmental characteristics of the subject property. This section should be made more per-missive by substituting the word may for shall since some sites may not have any significant environmental values . 6 . Section 2 .4 . 2 . (iii) (d) of the section on Environment requires the inclusion of the opinion of land owners of the site and of those of adjacent properties in the Environmental Impact Statement. Since an environmental analysis is performed by a professional whose scientific judgement is sought, it seems of questionable value to include the non- professional opinion of land owners in an Impact Statement.
