REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF June 11, 1979
REPORT NO. : P-87-79
SUBJECT: Restricted Area By-law #78-117. An Amendment to Restricted
Area By-law 2111 of the former Township of Darlington (Henderson)
BACKGROUND:
By-law #78-117 permits a single family dwelling and butcher
shop on Part of Lot 18, Concession 7, within the Hamlet of Enniskillen.
The By-law was considered by Council at their regular meeting
of April 9, 1979 and was adopted with amendments at that time.
By-law 78-117 was advertised and notice given to all property
owners within 400 feet of the subject site as required in the Ontario
Municipal Board Revised Rules of Procedure. As a result of the circulation
of the By-law, two letters of objection were filed with the Town Clerk
(attached) .
According to the Revised Ontario Municipal Board Rules of Pro-
cedure, Town Council must review the objections filed and forward a copy
of their position in respect of the objections to the Municipal Board.
It is not necessary to forward reasons in support of Council's position.

The objections list a number of reasons for objecting to
By-law 78-117 noting that the subject site is currently for sale.
COMMENT:
At the discretion of Council, By-law 78-117 may be repealed
and/or repealed and revised in an attempt to accommodate the expressed
concerns. Alternatively, Council may advise the Municipal Board that
it wishes to proceed with By-law 78-117.
Staff note that any person may object to a restricted area
(zoning) by-law and the Ontario Municipal Board should hold a public
hearing for the purpose of inquiring into the merits of the application
and hearing any objections that any person may desire to bring to the
attention of the Municipal Board.
If Council wishes to proceed with By-law 78-117, staff note
that a further report will be forwarded to Committee in respect of the
Town's position at a Municipal Board Hearing.
RECOMMENDATION:
That the Planning and Development Committee recommend to
Council that:
1. By-law 78-117 be considered in the light of the objections
filed.

Dear Sirs,
We wish to submit our opposal to the re-zoning of the Wm.
Henderson ,property in lot 18, corm , 7, in the village of' Ennisk-

1- Poor location due to traffic on the 8th, Conn, and no, suit-
able parkin; area .
2- No need for such an outlet in village as we have a very good
general store
g and the population is not large enough, to
support two shops .
3- It willde-value the surrounding properties, as the build-
ing, a converted car garage , is not suitable, and if all-
owed to be expanded would only look less attractive, as,
the buildings and property have gone down hill every year
since Mr . Henderson moved here . ,
5- The ad-joining road to the property, is only 33 ft . wide, and
and runs in front of our property and we have been led to,
believe, in a round about way, that we would not be allowed
to build on our lot, due to the width of the road .
6- If this outlet is allowed to proceed, it could lead to other
such outlets and would lead to the down grading of our vill
-age .
7-The conversion of the present building, wa, done without, the
proper permits and permission of the officals, and we feel, if
Mr .Henderson is allowed to continue, he will, no doubt, con-
tinue to do, just whatever he feels like doing, he ha

done in the past. F
We strongly oppose any re-zoning or busniess being carried on
at this location .
We have already been to a planning board and council meetings
to express our opposal to this plan .
Also Mr.Henderson has alr�edy advertised the property in the
local Times and Toronto papers, under Busniess Opportunies.

Further more, how can a food outlet be opperated , when, they
kep keep a bunch of horses and there is a pile of manure at the
location all the time.
