SUBJECT: Town's Position Regarding O.M.B. Referrals of Durham
Regional Official Plan
4. Extension of Urban Boundaries (Newcastle Village)
R-60, R-61, R-62, R-63, R-64
BACKGROUND:
The above noted referrals are all related to requested
extensions to the Newcastle Village Urban Area boundaries.
With the exception of R-60 and R-62, we have very little
background information with which to address these referrals. Therefore,
the attached table summarizes the details of each referral and the
current Town position. With respect to R--62, reference should be made
to staff report P-58-79.
Recommendation: That Planning and Development Committee recommend
to Council the following:
1. That this report be received; and that
2. The Region of Durham be advised of the Town's
position relative to referrals R-60, R-63 and
R-64; and that

3. Mr. D. Sims, Town Solicitor, be advised that
his presence is not required at those hearings
dealing with the referrals noted in (2) above.

Moved by Councillor Holliday, seconded by Councillor Clarke ,
WHEREAS fine Ridge Park Limited have resolved their expropriations
by Ontario Hydro and the sari 1 ement. issues between them;
AND WII1 %'k/\S the previous Councils of the Town of Newcastic •rave
supported the consent for a modification to the Regional Official
Plan to accommodate this development;
AND WHEREAS the time constraints regarding Ontario Municipal
Board hearings are of the essence;
THEREFORE BE IT RESOLVED that this Council reconfirms its approval
for a retirement mobile home on as much of the lands controlled
by Pine Ridge Park Limited as is surplus to Ontario Ilydro' s
actual right-of-way requirement and again request the Reg;i.or,
to consent to a modification to their flan accordingly.
Mayor Rickard ruled that the foregoing Resolution was out
of order, but was challenged by Councillor Holliday and thr
Mayor's ruling; was not upheld by Council .
His Worship vacated the Chair in favour of Councillor Clarke
and on being put: to a vote Resolution 11C-504 -79 was
Carried .

WHEREAS the construction of Highways Number 115 and 401 and
the presposed Solandt 1"dro Corridor and the widening of the:
C.N. R. main line and the construction of a service road have
all seriously segmented this property;
hND WHEREAS the applicant has a decision of the Supreme
Court of Ontario registered on Title giving; him legal accer
to the abutting hightgay;
AND WHEREAS the property concerned has been destroyed as
viable agricultural entity and its highest and boot possible i
