SUBJECT: Application for Rezoning No. Z-A-1-13-3 - Part of Lots
25 and 26, Concession 6, former Township of Darlington
Ralph Davis
1 . Background:
Application for Subdivision Number 18T-78107 received
draft approval from the Minister of Housing on March 20, 1979.
This Plan, which proposes the subdivision of a 21 acre
parcel in Solina into 8 single family residential lots, a 6.9 acre
parkland block, and a 2.4 acre Block to be reserved for future develop-
ment, was recommended for draft approval by Town of Newcastle Council
on October 10, 1978.
. One of the conditions of draft approval imposed by the
Minister of Housing required:
"(a) that prior to the signing of the final plan by the
Minister, we are to be advised that the proposed
subdivision conforms with the restricted area by-law
approved by the Ontario Municipal Board under Section
35 of the Planning Act", and

"(b) that the By-law referred to in condition (a)
zone that area on Block C and Lots 3, 4 and 5
downslope from the floodline, as marked on the
plan, open space. The zone shall preclude the
erection of all buildings or structures other than
those necessary for flood or erosion control . "
2. Comments:
The land covered by this draft plan is presently zoned
"Deferred Development" and "Greenbelt" in the Darlington Zoning By-law.
The "Deferred Development" zone permits residential development, but
also permits agricultural uses. In addition, the "Deferred Development"
zone requires larger lots than those proposed by the draft plan.
We support the applicant's request that the lands to be
developed for residential uses be zoned "R2" to reflect the zoning of
the rest of the Hamlet.
The present limits of the "Greenbelt" zone on the site do
not correspond with the floodline as delineated by the Central Lake
Ontario Conservation Authority. It is recommended that the boundaries
of this zone be adjusted to reflect the Conservation Authority Mapping.
The block proposed for future development should retain its
present "Deferred Development" zoning, in order to ensure that this lot
is not developed until the Hamlet Development Plan has been amended to
permit an additional lot in this quadrant of Solina.
3. Recommendations:
It is recommended that application for rezoning number Z-A-1-13-3
be approved, and that the attached amending By-law be forwarded to Council
for consideration.

A By-law to amend Restricted Area By-law Number
2111 , as amended, of the former Township of
Darlington.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111 , as amended,
of the former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1 . Key Map 12 of Schedule "A" to By-law 2111 , as amended,
is hereby amended by changed to "R2" , and "G", respectively,
the zone designations of those lands designated, "ZONE
CHANGE TO R2" and "ZONE CHANGE TO G" on the attached Schedule
hereto.
2. This By-law shall come into effect on the date hereof,
subject to receiving the approval of the Ontario Municipal
Board.
