(416)263.2231 TO: Chairman & Members of the REPORT NO. P-28-79 Planning & Development Committee DATE: February 15, 1979 SUBJECT: Architectural Controls 1 . Background At the January 22, 1973 meeting of the Planning and Development Committee, questions were raised about the mechanics of imposing architectural controls in the Town of Newcastle, to ensure the com- patibility of new residential development with existing development. In order to determine whether Architectural Controls were being successfully imposed in other municipalities in the region, the Town of Ajax, the City of Oshawa, the Town of Pickering, and the Town of Whitby were contacted. This survey indicated that the imposition of Architectural Control is not consistent across the Region, but varies as follows: (i ) The Cif of Oshawa - has no mechanism for Architectural Control for low density residential development. (ii ) The Town of Ajax - requires the developer to submit house elevations and location plans. These plans are reviewed by a Committee of Department Heads, whose actions are ratified by executive committee. This requirement is imposed as one of the provisions of the subdivision agreement. �" 2 _ (iii ) The Town of Pickering - also imposes architectural control through the provisions of the subdivision agreement, which requires that building elevations and an overall site plan showing house locations be approved by Planning Staff before a building permit is issued for any lot within the subdivision. (iv) The Town of Whitby - establishes,--an Architectural Control Committee for'each new subdivision through the provisions of the subdivision agreement. This committee consists of representatives of- the Developer, a representative ofrt a4 Planning Departments, and a Control Architect selected by the Town but paid by the Developer. This Committee produces a set of standards to con- trol the aesthetics of the development in the par- _ ticular subdivision. The subdivision agreement con- tains a provision that no building permit is available for any lot in the subdivision until the plans and elevations have been approved by the Committee. (We note that because each subdivision has a different Architectural Committee, there is no consistency in the imposition of control measures. ) 2. Comments We agree that Architectural Control is a desirable goal , especially for subdivisions in Newcastle Village and the Hamlets. However, a policy of implementation as complex as that evolved in the Town of Whitby would, in our opinion, be expensive and time consuming and could result in the i - 3 - application of different standards throughout the Planning Area. Instead, we support the type of control mechanism practiced by the Town of Ajax and the Town of Pickering, where plans are reviewed by staff and ratified by Council . 3. Recommendations It is, therefore, recommended: 1 . That the Standard Form of Subdivision Agreement used by the Town be amended by the insertion of a clause requiring that no building permit or residential uses in the subdivision may be issued until the elevations and a location plan indicating the distribution of house types has been approved by Council . 2.
