SUBJECT: Amendment to the Bowmanville Official Plan O.P.A. 177,
Cadillac Fairview Corp. - File: 0-A-1-1-2
Comments:
Further to Committee Resolution PD -3-79 passed at the meeting
of January 22, 1979, we submit the following comments.
The North-Central Bowmanville Planning Study, as submitted in
support of the above noted Official Plan amendment, has been reviewed,
by staff and discussed with the consultants for Cadillac Fairview. In

that regard, it is their desire that this application be processed con-
current with the preparation of the Bowmanville Urban Area Plan to ensure
that their options and interests are adequately protected. It is our
position that the proposal, which complies with the Durham Regional
Official Plan, will also comply with the Bowmanville Urban Area Plan
upon its completion, and is therefore acceptable in principle. However,
prior to development actually taking place, it will be necessary for the
Town to either further amend the Bowmanville Official Plan, or to adopt
a neighbourhood development plan which will comply with the approved
Bowmanville Urban Area Plan. A further restriction affecting -the develop-
ment, will be the provision of the necessary municipal services by the ��,1

Region, the timing of which has yet to be determined.
The proposed amendment has been circulated to concerned agencies
and we have received no objections to it. We are, therefore, in a
position to make a recommendation.
Recommendation:
Based on the foregoing, discussions with the applicant's consult-
ant and our review of the proposal, we recommend the following:
1. That the Region of Durham be advised that the Town has
no objection to Official Plan Amendment 177 being an amend-
ment to the Bowmanville Official Plan; and that
2. The limits of the proposed amendment be expanded to include
the balance of the study area as delineated within the re-
vised amendment attached herein; and that
3. The North-Central Bowmanville Planning Study as submitted,
on behalf of the applicants, be used as input to the detailed
studies which are pre -requisite to permitting development to
take place.

This Amendment No. to the Official Plan for the
former Bowmanville Planning Area, which has been
adopted by the Regional Municipality of Durham, is
hereby approved in accordance with Section 17 of The
Planning Act, as Amendment No. to the Official
Plan for the former Bowmanville Planning Area (now
in the Regional Municipality of Durham Planning Area).

The attached map entitled Schedule 'A' and explanatory
text constituting Amendment No. to the Official Plan
for that portion of the Durham Planning Area which on
the 31st day of December, 1973 comprised the Town of
Bowmanville Planning Area, was recommended for approval
by the Council of the Town of Newcastle by resolution
on , pursuant to Sections 60 and 61
of Bill 162 - An Act to Establish the Regional Municipality
of Durham.

being a by-law to adopt Amendment Number to the Official Plan for
that portion of the Durham Planning Area which on the 31st day of
December 1973 comprised the Town of Bowmanville.
WHEREAS the Regional Municipality of Durham Act and the
Planning Act as amended, authorized the Regional Municipality of
Durham to pass by-laws for the adoption of the Official Plan and
amendments thereto.
NOW THEREFORE, BE IT ENACTED AND IT IS HEREBY ENACTED as a
By-law of the Regional Municipality of Durham by the Council thereof
as follows:
1. That Amendment Number to the Official Plan for that
portion of the Durham Planning Area which on the 31st day of December
1973 comprised the Town of Bowmanville being the attached Schedules
'A', 'B', and V.
2. That the Clerk of the Regional Municipality of Durham is
hereby authorized and directed to make application to the Minister of
Housing for approval of the aforementioned Amendment Number to
the Official Plan for that portion of the Durham Planning Area which
on the 31st day of December 1973 comprised the Town of Bowmanville.
3. This by-law shall come into force and take effect on the
day of the final passing thereof.

Amendment No. to the Official Plan of the former Planning Area of
the Town of Bowmanville now part of the Durham Planning Area.
Purpose of The purpose of this Amendment is to re -designate
the Amendment approximately 70 acres of land located adjacent to
the existing designated urban area to permit resi-
dential development within the "Stage 1 Development
Area" as described in the Official Plan of the
former Planning Area of the Town of Bowmanville.
Location The subject lands are generally located north of
the existing developed urban area, being part of
Lots 11 and 12, Concession II, west of Liberty Street
as shown on Schedules 'A', 'B' and 'C' attached.
Basis This Amendment provides for the availability of
appropriately designated lands to permit residential
development within the Stage 1 Development Area of
the Bowmanville Major Urban Area. Such an amendment
is in accordance with the policies and intent of
the Durham Regional Official Plan.
Actual The Official Plan of the former Planning Area of the
Amendment the Town of Bowmanville is hereby amended by:
1) Amending Map 1 - Urban Development Area Staging
and Services by redesignating the lands identified
on Schedule 'A' attached, to "Stage 1 Development"
Area and adjusting the Urban Development Area
boundary accordingly.
2) Amending Map 3 - Land Use Plan by deleting the
"Rural" designation and replacing it with the
"Residential - Low Density" designation as shown
on Schedule 'B' attached.
3) Amending Map 4 - Special Planning Areas by en-
larging the "Neighbourhood Planning Area No. 4"
boundary to reflect the land use change identified
in 2) above, as shown on Schedule 'C' attached.
Implementation This amendment shall be implemented by the registration
of plan(s) of subdivision.
Interpretation The provisions of the Official Plan as amended from
time to time regarding the interpretation of that plan
shall apply in regard to this amendment.
