(416)263-2231 TO: Chairman & Members of the REPORT NO. P-12-79 Planning & Development Committee DATE: January 17, 1979 SUBJECT: By-law 77-84 (Cedar Park) 1 . Background The subject By-law amends the Darlington Zoning By-law by changing the zone designation of a 28 acre parcel in part of Lot 15, Concession 6, from "Open Space" to "TC-1 ". This would permit the development of 100 camp lots on the site. The circulation of the proposed By-law to neighbouring residents resulted in the submission of 33 objections I to the By-law, and an Ontario Municipal Board Hearing was scheduled for January 16, 1979 to deal with these objections. On December 18, 1978, the following resolution of the Planning and i Development Committee was approved by Council : "That Report #P-107-78 be adopted. The recommendations being as follows: 1 . That Planning Staff and the Town Solicitor be authorized to attend the Ontario Municipal Board Hearings regarding By-laws i 77-84 and 77-85, and" i i I - 2 - I "2. That Council advise the Ontario Municipal Board that it has no objection to an amendment to By-law 77-84 to require a Site Plan Agreement under Section 35(a) of the Planning Act as a condition of the development of a recreational trailer park on the site. " The Ontario Municipal Board was informed of the Town' s position I in this matter, both by letter dated December 20, 1978 to Mr. Andrews, Chairman of the Board, and by Staff testimony at the Hearing. Mrs. Staples also appeared at the Hearing to advise the Board that the majority of the residents affected by the By-law would withdraw their objections to the By-law if the controls provided by Section 35(a) of the Planning Act were imposed on the site. As a result of these representations, the Ontario Municipal Board Member, in his verbal decision, stated that he could not approve By-law 77-84 as submitted, but would recommend j i approval of said By-law, without further circulation or public notice, if the By-law were amended to apply the provisions of Section 35(a) of the Planning Act to the site. i We have prepared a By-law to effect the required amendment to By-law 77-84, and have enclosed it for your consideration. 2.
