P-8-79 Planning & Development Committee DATE: January 17, 1979 i SUBJECT: Application for Rezoning No. Z-A-3-12-7, Part of Lots 29 and 30, Concession 1 , former Village of Newcastle. 1 . Purpose of Application On December 20, 1978, an application was submitted requesting the rezoning of a 28.9 acre parcel in Part of Lots 29 and 30, Concession 1 , Village of Newcastle. The proposed rezoning would permit the development of a draft approved subdivision comprising 100 single- family Lots, a 2.55 acre park site, and a 2.6 acre open space block. 2. Official Plan Provisions The site is designated "Residential " and "Major Open Space" in the Region of Durham Official Plan. The proposed rezoning would comply with the permitted uses of these designations. I 3. Zone Provisions The site is zone "R1 " in By-law 73-15 of the former Village of Newcastle. However, since this By-law has not been approved by the Ontario Municipal Board, it could not be used to control the proposed development of the site. 'While the Town intends to submit this By-law - 2 - to the Ontario Municipal Board in the near future, its approval could be delayed for a considerable period of time, especially if a hearing is required. i Moreover, since the frontage and area of the lots contained within this draft approved plan do not comply with the requirements pro- posed by the "R1 " zone in By-law 73-15, an amendment would be re- quired to the By-law to permit the proposed development. As an alternative to tying the development of these lands to the approval of By-law 73-15, it is recommended that if the subject application for rezoning is a site specific zoning By-law should be prepared and submitted to the Ontario Municipal Board for approval . 4. Circulation of Application Since the proposed rezoning relates to a draft approved plan of subdivision and since this subdivision plan was given a full cir- culation before draft approval was granted by the Minister of Housing, we did not feel it was necessary to circulate the application for re- zoning to a large number of agencies for comments. Accordingly, the I subject application was circulated only to the Durham Planning De- partment and Bell Canada. None of these agencies objected to the proposed rezoning. We have been advised by the Region of Durham Planning Department that the proposal complies with the policies of their Official Plan and that water and sewage facilities will be available to service the development by late summer or early fall i this year. i i i i - 3 - �i 5. Comments Since the proposed rezoning would allow the development of a subdivision which was approved in 1972, we would have no objection to its approval , provided that the flood plain lands on the eastern boundary of the site are included within an Environmental protection zone to restrict the location of buildings thereon. 6. Recommendation I It is recommended: 1 . that application for rezoning number Z-A-3-12-7 be approved, and that a site specific zoning by-law be applied to the subject lands; and 2. that the attached zoning By-law be forwarded to Council (for approval) Respec fully submitted, NJF: lb Leslie L.
