SUBJECT: PROPOSED AMENDMENTS TO THE DARLINGTON OFFICIAL
PLAN, BOWMANVILLE OFFICIAL PLAN AND NEWCASTLE
VILLAGE OFFICIAL PLAN - FILE: 83-26/ND/NB/NV

RECOMMENDATION:
I
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the
following:
1 . That Report PD-178-83 be received, and
2. That Council approve proposed Amendment No. 19
to the Official Plan of the former Township of
Darlington, proposed Amendment No. 1 to the
Official Plan of the Bowmanville Urban Area,
and proposed Amendment No. 1 to the Official
Plan of Newcastle Village Small Urban Area, as
attached to Staff Report PD-178-83; and
3. That Council request the Region of Durham to
approve the amendments referenced in
Recommendation No. 2 above at such time as the

to the Durham Regional Official Plan; and

4. That Council request the Minister of Municipal
Affairs and Housing to approve the amendments
referenced in Recommendation No. 2 above at
such time as the Minister approves Official
Plan Amendment 83-26/D to the Durham Regional
Official Plan; and
5. That a copy of Staff Report PO-178-83 and the
amendments attached thereto be forwarded to the
Region of Durham for their information and
consideration.
BACKGROUND AND COMMENTS:
On June 2.0, 1983, the General Purpose and Administration
Committee considered Staff Report PD-95-83. The Report
addressed the issue of severance applications and the
development of existing lots of record in urban areas prior
to full municipal services being available. Committee
resolved (Resolution #GPA-547-83) to request the Region of
Durham to undertake an amendment to the Regional Official
Plan to accommodate urban severance applications and to
permit development of existing lots of record, conditional
upon Health Unit approvals and subject to satisfying the
requirements of the Regional Municipality of Durham. This
recommendation was subsequently endorsed by Council at its
meeting of June 27, 1983 (Resolution #C-504-83).
On July 13, 1983, the Region advised the Town that Council 's
resolution was being processed as a proposal to amend the
Durham Regional Official Plan. The Region circulated the
amendment proposal to the other area municipalities for
comment and placed a public notice in various newspapers
throughout the Region.

On October 5, 1983, the Region advised the Town that based
on the comments received through the circulation of the
proposed official plan amendment, they would be preparing a
draft amendment to the Durham Regional Official Plan which
will be forwarded to all the area municipalities, including
the Town of Newcastle, for further comment.
Staff note that the Official Plans of the Bowmanville Urban
Area, the Newcastle Village Small Urban Area, and the former
Township of Darlington (Courtice) will also require amending
in order to implement the amendment to the Durham Regional
Official Plan.

To that end, Staff have prepared amendments to these three
* Official Plans (attached) for Council 's consideration. The
effect of these amendments would be to permit limited
residential infilling and limited residential severances in
Courtice, Bowmanville and Newcastle Village prior to the
availability of full municipal services.
Staff conducted a review of the residential development
potential arising from the proposed amendments. Within the
Bowmanville Urban Area, there would be as many as twenty-six
existing lots of record which do not presently benefit from
existing services , as well as a potential for eighteen lots
to be created through infilling. In Courtice, Staff
estimate the number of existing lots of record as forty-two,
with the potential for infilling at fifty-two. Newcastle
Village on the other hand, has only five existing lots of
record, and a potential for four new lots. Staff wish to
emphasize however, that these figures are estimates only.
Staff note that the proposed amendments to the Bowmanville,
Newcastle Village and Darlington Township Official Plans
will not be approved and come into effect until the related

amendment to the Durham Regional Official Plan is approved
by the Region and the Minister of Municipal Affairs and
Housing.
It is therefore recommended that Council endorse the
proposed amendments attached to this Report, and request the
Region of Durham to approve them at such time as they
approve the related amendment to the Durham Regional
Official Plan.

AMENDMENT 19 TO THE OFFICIAL PLAN OF THE FORMER TOWNSHIP
OF DARLINGTO , NOW PART OF THE TOWN OF NEWCASTLE.
PURPOSE: The purpose of this amendment is to permit the
consideration of severance applications and to
permit residential infilling on existing lots
of record within the Courtice Major Urban Area
prior to the availability of municipal water and
sanitary sewer services.
BASIS: This amendment to the Official Plan of the
former Planning Area of the Township of
Darlington is based upon a review of policies
in the Courtice Urban Area Plan requiring the
provision of full municipal services as a con-
dition of residential infilling.
LOCATION: The area subject to this amendment is defined as
the Courtice Major Urban Area as delineated by
Schedule 1 to the Official Plan of the former
Township of Darlington.
ACTUAL: The Official Plan of the former Township of
Darlington is hereby further amended by:
1) Deleting in its entirety, Section 6. 1.3 iv)
and
2) Inserting the following Section 6.1.3 iv) :
6.1.3 iv) Infilling on existing road frontages
shall generally be permitted. Infil-
ling in excess of three lots may re-
quire a plan of subdivision in con-
formity with the Durham Regional
Official Plan, as amended from time to
time. Limited residential infilling
on existing lots of record and on lots
created by consent may be permitted
prior to the availability of full
municipal services.
3) Deleting in its entirety, Section 6.9.4 g) ;
and
4) Inserting the following Seciton 6.9.4
6.9.4 g) Where full municipal services are not
available, consents may be granted
prior to the availability of such
municipal services subject to com-
pliance with the regulations of the
Ministry of the Environment as en-
forced by the Durham Regional Health
Unit.

URBAN AREA, PART OF THE TOWN OF NEWCASTLE.
PURPOSE: The purpose of this amendment is to permit the

1) Deleting in its entirety, Section 2.1.3 iv)
and
2) Inserting the following Section 2.1.3 iv) :

sent may be permitted prior to the

Newcastle Village Small Urban Area is based upon

LOCATION: The area subject to this amendment is defined as
the Newcastle Village Small Urban Area as
delineated by Schedule 1 to the Official Plan of
the Newcastle Village Small Urban Area .
